In 1998, the Montgomery County Circuit Court implemented the DCM Plan to ensure efficient management of cases and certainty in trial dates. A DCM Plan was developed for Criminal, Civil and Domestic cases (and later for Juvenile cases following the inclusion of the juvenile docket in Circuit Court). DCM is a case management system that sets deadlines for completion of events in cases that are filed (such as discovery deadline dates, expert witness designation dates, and filing dates for certain motions and mandatory pleadings). The DCM Plan also allocates judicial resources based on the needs of the individual cases. A tracking system was established and each case is assigned a Track from Track 0 through Track 10, based on the type of case, the complexity of the case, the length of trial time needed, and other factors.
TYPES OF CASES
Cases filed in the Circuit Court for Montgomery County can be broken down into the following four (4) broad categories: Criminal, Civil, Domestic and Juvenile. Within each of those categories there are several different types of cases; a non-exhaustive list of examples is set forth below.
- Criminal: These cases are filed by the State’s Attorney’s Office.

Civil: These cases are brought by counsel on behalf of litigants and by self-represented litigants and include many different types of cases. Some examples include the following: contract disputes, personal injury (such as motor vehicle accidents and medical malpractice), professional malpractice, employment/workplace disputes (such as discrimination, wrongful discharge, worker’s compensation, and union disputes), real estate disputes (such as foreclosures, community association and neighborhood association disputes, construction disputes, and adverse possession claims), business/corporate, and technology disputes.
Family: These cases are also filed by private counsel on behalf of litigants and by self-represented individuals. Some examples include the following: name change requests, amendments to birth certificates and marriage licenses, divorce, annulments, child custody, child support, division of property and domestic violence.

Juvenile: These cases are filed by the State’s Attorney’s Office and the County Attorney’s Office and include termination of parental rights, child in need of assistance and supervision and delinquency matters.
