Consumer Tip of the Week:  October 13, 2008 

Office of Consumer Protection Announces Activities for Hispanic Heritage Month/ Actividades de la Oficina de Protección al Consumidor (OCP) Durante el mes de la Herencia Hispana

In honor of National Hispanic Heritage Month, September 15 – October 15, Montgomery County’s Office of Consumer Protection (OCP) is focusing its consumer education activities on the Hispanic community and will be participating at several health fairs and community festivals in the county. “We want to make sure that Spanish speaking residents in the county know that we are here to help them become informed and confident consumers,” said OCP director Eric Friedman. In addition, our "Tip of the Week" will be in English and in Spanish.

Foreclosure Rescue Scams

If you’re having trouble paying your mortgage or you have gotten a foreclosure notice, contact your lender immediately. You may be able to negotiate a new repayment schedule. Remember that lenders generally don’t want to foreclose; it costs them money.

Other foreclosure prevention options, including reinstatement and forbearance, are explained in the Federal Trade Commission's publication: Mortgage Payments Sending You Reeling?

You also may contact a credit counselor through the Homeownership Preservation Foundation (HPF), a nonprofit organization that operates the national 24/7 toll-free hotline (1.888.995.HOPE) with free, bilingual, personalized assistance to help at-risk homeowners avoid foreclosure.

Red Flags To Avoid Foreclosure Rescue Scams

  • If you’re looking for foreclosure prevention help, avoid any business that:
  • guarantees to stop the foreclosure process – no matter what your circumstances
  • instructs you not to contact your lender, lawyer, or credit or housing counselor
  • collects a fee before providing you with any services
  • accepts payment only by cashier’s check or wire transfer
  • encourages you to lease your home so you can buy it back over time
  • tells you to make your mortgage payments directly to it, rather than your lender
  • tells you to transfer your property deed or title to it
  • offers to buy your house for cash at a fixed price that is not set by the housing market at the time of sale
  • offers to fill out paperwork for you
  • pressures you to sign paperwork you haven’t had a chance to read thoroughly or that you don’t understand.

Estafas de Rescate de Ejecución Hipotecaria

Si tiene problemas para pagar su hipoteca o si ha recibido un aviso de ejecución hipotecaria, establezca contacto con la entidad de préstamo inmediatamente. Es posible que pueda negociar un nuevo programa de pago. Recuerde que en general, los prestadores no quieren hacer ejecuciones hipotecarias porque son procedimientos que cuestan dinero.

  • Si usted anda buscando ayuda para evitar la ejecución hipotecaria de su vivienda, evite a los negocios que digan o hagan lo siguiente:
  • Le garantizan detener el proceso de ejecución – sin consideración de sus circunstancias particulares.
  • Le dicen que no se comunique con su entidad de préstamo, abogado o asesor de crédito o de vivienda.
  • Le cobran un cargo antes de prestarle el servicio.
  • Únicamente aceptan pagos efectuados con cheques de caja o transferencia de fondos.
  • Lo alientan a alquilar su casa para comprarla nuevamente con el transcurso del tiempo.
  • Le dicen que les pague directamente a ellos las cuotas de su hipoteca en lugar de pagárselas a su entidad de préstamo.
  • Le dicen que transfiera la escritura o título de propiedad de su vivienda a nombre de ellos.
  • Le ofrecen comprar su casa en efectivo pagando un precio fijo no establecido por el mercado inmobiliario en el momento de la venta.
  • Le ofrecen completar documentación o formularios por usted.
  • Lo presionan para firmar documentación o documentos que usted no entiende sin brindarle la oportunidad de leerlos atentamente.

Consumer Protection Charges Unlicensed Home Improvement Contractor

Following an investigation by Montgomery County’s Office of Consumer Protection (OCP), an arrest warrant has been obtained for an unlicensed home improvement contractor who was paid $82,500 but failed to provide the agreed upon services. The warrant, issued on January 17, charges Cesar Suazo Rivera of Falls Church, Virginia with acting as a home improvement contractor without the required license, abandoning the job, and felony theft.  Certified Electrical Products -- What Should Consumers Look For?

Montgomery County's Fire and Rescue Service and Office of Consumer Protection (OCP) announced at a news conference on January 28th that they have found and removed electrical space heaters and extension cords, as well as other potentially dangerous electrical items being sold throughout Montgomery County that were not properly tested and certified. County and State laws provide that it is illegal to sell electrical products unless they are clearly labeled with the symbol from a certified testing laboratory.

Consumers can check to see if items have been tested by a certified testing laboratory by checking the Maryland State Fire Marshal's website for a full list of approved testing laboratories. You can also check to see if products are certified by Underwriters Laboratories (UL) or Electrical Testing Laboratories (ETL) by going to their websites.

Gift Card Reports

Just in time for the holiday shopping season, the Office of Consumer Protection has issued its fifth annual gift card study. "Gift Cards 2007: Best and Worst Retail Cards; A Deeper View of Bank Cards Doesn't Improve Their Look."  The report contains valuable information and recommendations regarding gift cards issued by 22 major retailers and restaurant chains and 20 bank card issuers.
