(northern intersection) from the eastern most property line of 3231 Coquelin Ter. to Jones Mill Rd., No Standing Any Time on south side of Coquelin Ter. (north intersection) from Jones Mill Rd. to 60' east of Jones Mill Rd.  Effective Date:  6/15/05.

 

MCEO NO. 192-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Nicholson Lane Bridge (CIP 500504).  The County Executive finds that public interest requires construction to replace and widen the Nicholson Lane Bridge No. M-113 over CSX Railroad, a public highway bridge located in Rockville, Maryland.  A public hearing was held on March 7, 2005, and the hearing examiner recommended approval of the project.  Therefore  the director of the Department of Public Works and Transportation is authorized to proceed with the construction to replace the existing Nicholson Lane Bridge over CSX Railroad and reconstruct approximately 65' of approach roadway to tie the new structure to the existing roadway on both sides.   Also the new bridge will be widened to accommodate the future implementation of the local master plan that calls for an on-road bike path in each direction.  The total estimated cost for the construction management and inspections, land acquisitions, utilities, site improvements, and construction is $3,352,000.00.   Effective Date:  6/21/05.

 

MCEO NO. 193-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Brink Road Bridge (CIP 500503).  The County Executive finds that public interest requires construction to replace the Brink Road Bridge over Goshen Branch Tributary, a public highway bridge located in Gaithersburg, Maryland.  A public hearing was held on the project on April 21, 2005, and the hearing examiner recommended approval of the project.  Therefore the director of the Department of Public Works and Transportation is authorized to proceed with the construction to replace the existing deteriorating Brink Road Bridge over Goshen Branch Tributary and to reconstruct approximately 850' of approach roadways to tie the new structure into the existing roadway on both sides.  Total estimated cost  is $1,689,000.00.  Effective Date:  6/21/05.

 

MCEO NO. 194-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Marlow Farm Community Association, Inc. c/o Darryl A. Burton, President Fairland Road Improvements - CIP 500402.  The option contract between Marlow Farm Community Association, Inc. c/o Darryl A. Burton, President, and Montgomery County, Maryland, for the granting of an easement for the Fairland Road  Improvements Project is accepted.  The County Attorney is directed to take all necessary steps to acquire an easement.  Effective Date:  6/21/05.

 

MCEO NO. 195-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION  - Acceptance of Option Contract with Maria T. Hernandez, Fairland Road Improvement Project, CIP No. 500402.  The option contract between Maria T. Hernandez and Montgomery County Maryland for the granting of an easement for the Fairland Road Improvements Project is accepted.  The County Attorney is directed to take all necessary steps to acquire an easement.  Effective Date:6/21/05.

 

MCEO NO. 196-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  INSTALL Stop on southbound Duvall Hill Ct. at Duvall Rd.  Effective Date:  5/15/05.

 

MCEO NO. 197-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  REMOVE No Parking Any Time on south side of Hopkins Rd. from 100' west of Kingsview Rd. to Kingsview Rd., on north side of Hopkins Rd. from Lark Song Dr. to 75' west of same; INSTALL No Parking Any Time on south side of Hopkins Rd. from 240' west of Kingsview Rd. to Kingsview Rd., on north side of Hopkins Rd. from Lark Song Dr. to 150' west of same, on north side of Hopkins Rd. from 185' east of Lark Song Dr. to 110' east of same.  Effective Date:  5/16/05.

 

MCEO NO. 200-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Surplus Administrative Transfer and Sale of Three (3) County-owned Properties.  A public hearing was held on May 5, 2005, to consider the recommendation that these properties referenced as P790 on Tax Map HR 61, P 318 on Tax Map GT22, and P455 on Tax Map GT12  be considered surplus and therefore be sold for purposes related to affordable housing. The public hearing officer recommended that the County Executive declare the properties surplus.  It is hereby ordered that the properties are surplus to the continued needs of Montgomery County  and are to be administratively transferred to DHCA to be sold for purposes related to affordable housing.   Effective Date:  6/24/05.

 

MCEO NO. 201-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Surplus, Administrative Transfer and Sale of (1) County-owned Property.  A public hearing was held on May 5, 2005, to consider the recommendation that the property referenced as Parcel P850 on Tax Map HT33 be considered surplus and therefore be sold for purposes related to affordable housing. The public hearing officer's report dated June 20, 2005, recommended that the County Executive declare the referenced property surplus to County needs and is to be available for sale through DHCA by a process that benefits the county through the encouragement of the development of affordable housing.  The property will therefore be administratively transferred to DHCA to be used or sold only for the purposes related to affordable housing.  Effective Date:  6/24/05.

 

MCEO NO. 202-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Quince Orchard Road (CIP 500502).  The County Executive finds that public interest requires construction to provide safety spot improvements along Quince Orchard Road, a public way located in Gaithersburg.   The improvements to be made are:  modification to existing medians and the alignment of the entrance to Quince Orchard High School with the shopping plaza across the street from the high school; improvements to the vertical curve near the intersection of Wonder View Way and Quince Orchard Road; spot safety improvement to the horizontal curve at Damson Dr.; construction of an eight-foot wide bikeway along the entire west side of Quince Orchard Rd. from Darnestown Rd. to 600' south of Brougham Way/Horse Center Rd.; construction of missing links of sidewalk along the east side of the roadway from Darnestown Rd. to Quince Mill Dr. A public hearing was held March 3, 2005, and the hearing examiner recommended approval of the project.  The total estimated cost of the project is $3,829,000.00.  Effective Date:  6/29/05

MCEO NO. 203-05:  DEPARTMENT OF LIQUOR CONTROL - FY06 Appropriation and Transfer.  State law provides for the Director of Finance and the Director of the Department of Liquor Control with the approval of the County Executive to determine the amount of working capital required by the Department and to retain from the Department's net profits (before making any deposit into the General Fund of the County) the funds necessary to service DLC related debt and provide adequate working capital for the operation of the DLC.  Because of this State law, both the County Attorney and the Attorney General have advised that the determination of the amount of funds required for these purposes is within the exclusive province of the County Executive, and is not subject to the County budget process.  It is ordered that the Director of Finance will transfer from the Liquor Control fund to the general fund,
at the end of each of the first three quarters of the fiscal year, an amount equal to one-fourth of the amount of $20,698,760 and the County Executive with the advice of the Department of Liquor Control, the Office of Management and Budget, and the Department of Finance will calculate the final quarterly transfer at the end of the fiscal year.  Provided that debt is issued for the Temperature Controlled Liquor Warehouse, the Director of Finance must also transfer up to $1,050,000 from the Liquor Control fund
 to the debt service fund to pay the outstanding principal and interest due on the lease financing.  Effective Date:  6/30/05. 

 

MCEO NO. 204-05:  DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS - Annual Price Adjustment for MPDU sales prices.  Section 25A-7(a)(4) of the Montgomery County Code 2004 as amended, states that the County Executive may make interim adjustments in the maximum MPDU sales prices when changes in residential construction costs justify a modification to the prices.  There have been significant increases in the cost of construction materials and products used in residential housing over the last year that justified an increase in the maximum sales prices of MPDUs.  Therefore there has been a 3.95 percent increase in the CPI-U from May 2004 to May 2005.  Effective Date:  6/30/05. 

 

MCEO NO. 205-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION  - Fairland Road Improvements - CIP Project 500402.  The option contract between Kenneth Lee Armstrong and Jennifer K. Hollis and Montgomery County Maryland for the granting of the easements for the Fairland Road Improvements Project is accepted.  In addition the contract will allow payment of an amount for additional landscaping if necessary.  The County Attorney is directed to take all necessary steps to acquire the easements.  Effective Date:   7/06/05.

 

MCEO NO. 206-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Fairland Road Improvements - CIP Project No. 500402.  The option Contract between Henry N. Carrera, Jr., and Montgomery County, Maryland, for the granting of an easement for the project, is hereby accepted.  The county attorney is directed to take all necessary stepts to acquire an easement.  Effective Date:  7/06/05.

 

MCEO NO. 207-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION -Fairland Road Improvements - CIP Project No. 500402.  The option contract between Dagim Seyoum and Abenet Shiferaw and Montgomery County Maryland for the purchase of land and granting of an easement for the Fairland Road Improvements Project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land and easement.  Effective Date:  7/06/05.

 

MCEO NO. 208-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Fairland Road Improvements - CIP Project No. 500402.  The option contract between Kevin Lon, Savorn Ok and Montgomery County Maryland for the granting of an easement for the Fairland Road Improvements Project is accepted.  The county attorney is hereby directed to take all necessary steps to acquire an easement.  Effective Date:  7/06/05.

 

MCEO NO. 209-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  INSTALL No Parking Any Time on the east side of  Crystal Rock Dr. from 150' south of Kinster Dr. to Kinster Drive.  Effective Date:  6/27/05.

Nelson and Montgomery County, Maryland, for the granting of easements for the Manor Park Drive Project is hereby accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the easements.  Effective Date:  7/11/05.

 

MCEO NO. 213-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - 10115 Patrick Ave., Rockville, Maryland, N. Potomac Recreation Center - CIP Project No. 720102.  The option contract between Lambert P. Durbin and Montgomery County, for the purchase of the property located at 10115 Patrick Ave. for the N. Potomac Recreation Center is hereby accepted.  The county attorney is hereby directed to take all necessary steps to acquire the property.  Effective Date:  7/11/05.

MCEO NO. 216-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Exeter Road Sidewalk (CIP 506747).  The County Executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Bethesda, Maryland and the director of the Department of Public Works and Transportation is authorized to proceed with the construction of a four foot wide concrete sidewalk conforming to ADA requirements on the east side of Exeter Rd. from 7609 Exeter Rd. to Moorland Ln. The sidewalk will be 300' long and the 22' wide roadway has a 50' public right of way.  The total estimated cost of the project including engineering site improvements and construction is $13,200.  Effective Date:  7/14/05. 

 

MCEO NO. 217-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Bonifant Street Sidewalk (CIP 506747).  The County Executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Silver Spring, Maryland, and the director of the Department of Public Works and Transportation is authorized to proceed with the construction of a 4' wide, 975' long, concrete sidewalk conforming to ADA requirements on the north side of Bonifant St., a secondary residential roadway 22' wide.  Bonifant St. has a 50' public right-of-way from Dale Dr. to Cedar St. located in Silver Spring.  The sidewalk will be constructed at the back of the existing curb and gutter.  The total estimated cost of the project, including engineering site improvements and construction will be $37,675.00.  Effective Date:  7/14/05.

 

MCEO NO. 218-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - MD190/River Road Sidewalk (CIP 506747). The County Executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Potomac, Maryland, and the director of the Department of Public Works and Transportation is authorized to proceed with the construction of a concrete sidewalk on the north side of MD190/River Rd. from Falls Rd. to 10219 River Road.  The sidewalk will be 5' wide, 600' long, and will conform to the ADA requirements.  River Road has a variable width of public right-of-way, the roadway is classified as a major roadway, and is approximately 50' wide.  Construction will require the purchase of right-of-way along two properties and the sidewalk will be constructed with a variable greenspace of zero to 3' in width between the sidewalk and curb.  The total estimated cost of the project including engineering site improvements and construction is $134,200.00.  Effective Date:  7/14/05. 

 

MCEO NO. 219-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Fernwood Road/Brixton Lane Sidewalk.).  The County Executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Bethesda, Maryland, and the director of the Department of Public Works and Transportation is authorized to proceed with the construction of a 800' long concrete sidewalk on the east side of Fernwood Rd. from Stoneham Rd. to 9715 Fernwood Rd. and on both sides of Brixton Ln. from Fernwood Rd. to existing sidewalks ending at 9717 and 9710 Brixton Ln. located in Bethesda, Maryland.   Fernwood Road is classified as a primary residential roadway, approximately 24' wide with a 70' public right-of-way and 23' of available public right-of-way on the east side of Fernwood Rd.  There will be 4' of greenspace between the sidewalk and existing roadway.  Brixton Lane is classified as a secondary residential roadway with a 60' public right-of-way.  It is 26'wide with on-street parking allowed on both sides of the roadway.  There is approximately 17' of available public right-of-way along both sides of Brixton Ln.  The sidewalk will be constructed with 11' of greenspace between the sidewalk and existing curb and gutter.  The total estimated cost for this project is $44,000.  Effective Date:  7/24/05. 

 

MCEO NO. 220-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Maryland Ave. Sidewalk (CIP 506747).  The County Executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Bethesda, Maryland and the director of the Department of Public Works and Transportation is authorized to proceed with the construction of concrete sidewalk on the east side of Maryland Ave. from Jones Bridge Rd. to South Chelsea Ln. located in Bethesda, Maryland.  The concrete sidewalk, 4' wide, 11' long, will conform to the ADA requirements.   Maryland Ave. is classified as a secondary residential roadway with a 50' public right-of-way, 22' wide, and the existing roadway is approximately 22'wide.   There is approximately 14' of available public right-of-way on east side of Maryland Ave.  The sidewalk will be constructed with zero foot greenspace and located at the back of a newly constructed concrete curb and gutter.  Total estimated cost of the project, including engineering site improvements and construction is $60,770.00.  Effective Date:  7/14/05.
