MCEO NO. 354-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Public Hearing - Abandonment of a Portion of an un-named right-of-way off Marywood Road, Marywood Subdivision, Bethesda.  The County Executive's designee conducted a public hearing at 1:00 p.m. on Monday, January 28, 2008, in the EOB Lobby Conference Room at 101 Monroe Street, Rockville, Maryland  20850, to consider an application received from Ms. Mimi Kress, the applicant seeking the abandonment. After the hearing, the hearing officer reported the findings and recommendations to the County Executive for further consideration as prescribed by County Code.  Effective Date:  11/26/07.

 

MCEO NO. 355-07:  DEPARTMENT OF  PUBLIC WORKS AND TRANSPORTATION - Public Hearing -Abandonment of a Portion of Pine Street, Hollywood Park Subdivision, Silver Spring.  The County Executive's designee conducted a public hearing at 2:00 p.m. Monday, January 28, 2008, in the EOB Lobby Conference Room, 101 Monroe Street, Rockville, Maryland  20850, to consider an application received from, Miles & Stockbridge on behalf of its client, AM Builders, LLC, the applicant seeking the abandonment. After the hearing, the hearing officer reported the findings and recommendations to the County Executive for further consideration as prescribed by County Code. Effective Date:   11/26/08.

 

MCEO NO. 356-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION- Public Hearing - Abandonment of Reed Street, Miller's Second Add. to Bethesda Subdivision, Bethesda.  The County Executive's designee conducted a public hearing at 1:15 p.m. on Monday, January 28, 2008, in the EOB Lobby Conference Room, 101 Monroe Street, Rockville, Maryland  20850, to consider an application received from Holland & Knight on behalf of its clients, Street Retail, Inc. JBG Companies, Frederick S. Burke, and Carter S. Kaufmann, the applicants seeking the abandonment. After the hearing, the hearing officer reported the findings and recommendations to the County Executive for further consideration as prescribed by County Code.  Effective Date:  11/27/07.

 

MCEO NO. 357-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION- Public Hearing - Abandonment of a Portion of Unimproved Prospect Avenue, Forest Glen Park Subdivision, Bethesda.  The County Executive's designee conducted a public hearing at 3:15 p.m. on Monday, January 28, 2008, in the EOB Lobby Conference Room, 101 Monroe Street, Rockville, Maryland   20850, to consider an application received from Mr. and Mrs. John M. Crye, Mr. Peter Collins, Ms. Kathy L. Kopnisky, Ms. Janet S. Kaplan, Mr. Robert J. Pellicoro, Mr. Adam Safir, and Ms. Theresa Nielson, the applicants seeking the abandonment. After the hearing, the hearing officer reported the findings and recommendations to the County Executive for further consideration as prescribed by County Code.  Effective Date:  11/26/07.

 

MCEO NO. 365-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION- Acceptance of Option Contract with Hoai Kieng and Eunah Chang.  The option contract for the purchase of land and the granting of an easement for the above referenced project is hereby accepted.    The County Attorney is directed to take all necessary steps to acquire the land.  Effective Date:  12/12/07. 

 

MCEO NO. 366-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION- Acceptance of option contract with Cherington Condominium, Montrose Parkway West, CIP 500311.  The option contract for the above-referenced project is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the land.  Effective Date:  12/14/07. 

 

MCEO NO. 367-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION- Public Hearing - the  County Executive's designee conducted a public hearing at 3:00 p.m. on Thursday, January 14, 2008, in the first floor auditorium of the EOB at 101 Monroe Street in Rockville, Maryland, to consider a proposal to construct and improve the extension of Century Boulevard, a public way located in Germantown, Maryland.  The following proposals were discussed:  construction of a new four lane divided closed section roadway from its current terminus south of the Oxbridge Tract to its intersection with future Dorsey Mill Road - the new road will be constructed below Father Hurley Blvd. at the existing bridge crossing; construction of a new three cell pipe Arch Culvert at the exiting stream crossing, construction of a five foot concrete sidewalk along east side and eight foot bikeway along west side, construction of storm drainage and storm water management facilities.  Total estimated cost for the project is $7,824, 000.  The executive order contains a listing of  the pre-sale owners, front footage and estimated cost.  Effective Date:  12/14/07. 

 

MCEO NO. 375-07:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION Acceptance of Option Contract with Juan Martinez and Maria Martinez, Woodfield Road Extended, CIP 500151.  The option contract for the purchase of land and the granting of an easement for the above referenced project is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the land.  Effective Date:  12/27/07. 

 

MCEO NO. 376-07:  DEPARTMENT OF PERMITTING SERVICES - Street Acceptance.  This order certifies that construction of the following named streets has been completed in accordance with all applicable provisions of  the Montgomery County Road Construction Code as specified in the permit.  The materials used in the construction of these streets were tested and found to be in compliance with county specifications.  Hidden Garden Lane (Wyncrest), Black Kettle Drive, Fable Drive (Hoyles Mill Village), Ashleigh Greene Road, Polynesian Lane, (Hoyles Mill Village), Rosemont Drive, Rosemont Circle, Rosemont Court (The Oaks at North), Molecular Drive, (Traville), Skylark Road (Greenway Village).  Effective Date:  12/27/07. 

 

MCEO NO. 1-08:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of option contract with Robert C. and Jaye Greenfest, Travilah Road, CIP No. 500101.  The option contract, for the purchase of land for the above referenced project is hereby accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land.  Effective Date:  1/04/08. 

 

MCEO NO. 2-08:  Office of Management and Budget - CIP Cost Criterion for Special Capital Improvements Projects FY09.  Whereas, Section 20-1 of the Montgomery County Code titled "Authorization of Special Capital Improvements Projects by Law," effective February 23, 1979, provides that non-emergency County Government capital improvements projects estimated to cost at least four million dollars must be approved by a law enacted by the County Council, prior to receiving further appropriation, and whereas the County Executive shall, by annual executive order, revise the four million dollar cost criterion for all major facilities to reflect the annual change in the latest published composite construction cost index established by the US Department of Commerce, and whereas the original cost criterion utilized by the County was $4,000,000 for special capital improvements projects; and the Office of Management and Budget has established the procedure utilized below to ensure consistency in the annual calculation of the cost criterion; and whereas the applicable composite construction cost index (1966=100) established by the U.S. Department of Commerce published in the Fisher Index was 46.1 for June 1978 and 158.6 for June 2007; and whereas the increase in the applicable composite construction cost index of 112.5 since 1978 indicates that the cost criterion established for special capital improvements projects for fiscal year 2009 should be $9,761,390 greater than the original cost criterion; now therefore the County Executive for Montgomery County, Maryland hereby establishes the cost criterion at $13,761,390 in accordance with Section 20-1 of the County Code, for the FY09 Capital Budget and the fiscal years 09-14 Capital Improvements Program.  Effective Date:  1/08/08.

 

MCEO NO. 8-08:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION- Acceptance of option contract with Michael Cerulli and Michele Cerulli, Woodfield Road Extended, CIP No. 500151.  The option contract between Michael Cerulli and Michele Cerulli and Montgomery County, Maryland, for the purchase of land for the referenced project is hereby accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land.  Effective Date:  1/14/08. 

 

MCEO NO. 9-08:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract wit h Michael Cerulli and Michele Cerulli, Woodfield Road Extended, CIP No. 500151.   The option contract for the purchase of land and the granting of an easement for the referenced project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land.  Effective Date:  1/14/08. 

 

MCEO NO. 18-08:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Pamela LaMarra, Falls Road and River Road Sidewalk, CIP No. 506747.  The option contract between Pamela LaMarra and Montgomery County, Maryland for the granting of easements for the referenced project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land.  Effective Date:  1/17/08.

 

MCEO NO. 19-08:   DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Potomac United Methodist Church, Falls Road and River Road Sidewalk, CIP 506747.  The option contract between Pamela LaMarra and Montgomery County, Maryland for the granting of easements for the referenced project is accepted.   The County Attorney is hereby directed to take all necessary steps to acquire the land.  Effective Date:  1/17/08. 

 

MCEO NO. 24-08:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Jackson road Sidewalk (south side) CIP 506747.  Public Hearing - the County Executive's designee conducted a public hearing at 3:00 p.m. on Wednesday, February 20, 2008, in the first floor auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland.  The purpose of the hearing was to consider a proposal to provide safe pedestrian travel on the south side of Jackson Rd. from MD 650/New Hampshire Ave. to the west entrance of the Martin Luther King Recreation Park parking lot located in Silver Spring, Maryland.  Plans for construction included:  a concrete sidewalk on the south side of Jackson Rd. from MD/650 New Hampshire Ave. to the west entrance of the Martin Luther King Recreation Park parking lot located in Silver Spring Maryland, to be built under the CIP project, 506747.  Jackson Road is classified as a primary residential roadway with a 70 foot public right-of-way.  The sidewalk will be five feet wide and will conform to the ADA requirements.  Total length of the sidewalk is 1,850 linear feet.  The existing roadway is approximately 36' wide and there are approximately 17 feet of available public right-of-way on the south side of Jackson Road.  There will be greenspace of 2 to 4 feet wide located between the sidewalk and curb.  For examination of related data and files, call 240/777-7270, Department of transportation.  Estimated cost of the proposed improvement and is $81,400.00 and funding will be by G.O.
