I Additional Licenses

A licensee holding a Class B beer, wine and liquor license (on-sale, hotels/ restaurants) may apply for an additional license or licenses subject to the provisions and limitations set forth in Article 2B, Section 9-102.1 (Additional Class B beer, wine and liquor licenses in Montgomery County).

II License combinations - maximum allowed

A LICENSEE THAT HOLDS AN "ORIGINAL LICENSE" MAY OBTAIN A MAXIMUM OF FIVE (5) ADDITIONAL LICENSES AND MAY NOT HOLD MORE THAN SIX (6) LICENSES ALTOGETHER.

A LICENSEE MAY HOLD ANY COMBINATION OF THE FOLLOWING LICENSES, NOT TO EXCEED SIX (6) LICENSES ALTOGETHER:

• ONE "ORIGINAL LICENSE"
• ONE "1-YEAR LICENSE"
• ONE "5-YEAR LICENSE" ($5000 ANNUAL FEE)
• ONE "EAST COUNTY LICENSE"
• ONE "ENTERPRISE ZONE LICENSE"
• ONE "GAITHERSBURG LICENSE"
• ONE "GERMANTOWN LICENSE"
• ONE "MONTGOMERY VILLAGE LICENSE"
• ONE "ROCKVILLE LICENSE"
• TWO "INCENTIVE LICENSES"

Types of Class B (BWL), H/R, On Sale Only Licenses

1. "Original License"
   The first license is obtained under the requirements of Article 2B, Sec.6-201(q).
   
   • a seating capacity of at least 30 persons is required.

2. "One year License"
   If licensee has held a Class B (BWL), H/R, On Sale license for at least 1 year, an additional license may be obtained if the applicant:
   
   • operates a restaurant, as defined by regulations of the Board.
   • has a capital investment of at least $250,000 (excluding the cost of the land or building) for the restaurant.
   • has a seating capacity of at least 125 persons.

3. "Enterprise Zone License"
   A licensee may obtain not more than two additional licenses for premises which are located in one of two designated enterprise zones (specific areas located in Silver Spring and Wheaton). A licensee can only receive one additional license in each enterprise zone.
   
   • The licensee is not required to have held a license for 1 year.
   • A seating capacity of at least 30 persons is required.
   • meets the requirements of an Enterprise Zone as specified in Article 83 A, Section 5-401(p).

4. "Gaithersburg License"
   A licensee may obtain one (1) additional license for premises located within the City of Gaithersburg.
   
   • The licensee is not required to have held a license for 1 year.
   • A seating capacity of at least 30 persons is required.

5. "Germantown License"
   A licensee may obtain one (1) additional license for premises located within the Germantown Town Center District.
   
   • The licensee is not required to have held a license for 1 year.
   • A seating capacity of at least 30 persons is required.

6. "Montgomery Village License"
   A licensee may obtain one (1) additional license for premises located within the Town Sector zoned area called Montgomery Village.
   
   • The licensee is not required to have held a license for 1 year.
   • A seating capacity of at least 30 persons is required.

7. "Rockville License"
   A licensee may obtain one (1) additional license for premises located within the Rockville Town Center zoned property.
   
   • The licensee is not required to have held a license for 1 year.
   • A seating capacity of at least 30 persons is required.

8. "Incentive License"
   A licensee may obtain two (2) additional licenses if the applicant:
   
   • operates a restaurant, as defined by regulations of the Board.
   • already has obtained an "Enterprise Zone License", a "Gaithersburg License", a Germantown License", a "Montgomery Village License", or a "Rockville License".
   • The licensee is not required to have held a license for 1 year.
   • A seating capacity of at least 30 persons is required.

9. "5 year license"
   A licensee may obtain one additional on-sale only license for premises if the applicant:
   
   • has been the holder of two (2) Class B (BWL), H/R, On Sale Licenses for at least five (5) years.
   • operates a restaurant as defined by regulations of the Board.
   • a seating capacity of at least 30 persons is required.

10. "East County License"
    A licensee may obtain one additional on-sale only license for premises located in an area bounded by the Howard County–Montgomery County line on the north; the Prince George’s County-Montgomery County line on the east; the Capitol Beltway (I-495) on the South; and a line 3,000 feet west of the center of Columbia Pike on the west.
    
    • The licensee is not required to have held a license for 1 year.
    • A seating capacity of at least 30 persons is required.
