Civil Department

The Civil Department handles medical malpractice, auto negligence, administrative appeals, District Court appeals, District Court jury demands, breach of contract, tax liens, enrolling judgments and foreign decrees, and miscellaneous petitions to accomplish very specific acts.

If you wish to file a complaint, you may refer to the Maryland Annotated Code and Maryland Rules of Procedure. The Civil Department receives the papers you prepare which can be served either by the sheriff or a private process server. The summons will be returned to the party filing the case for service unless a request is made for the sheriff to serve the summons. In that case, the summons will be forwarded to the Montgomery County Sheriff's Office for service with your check made payable to the Sheriff for $30.00 for each summons.

The filing fee for most civil cases is $105.00.

A. CENTRAL FILES

Central Files houses and protects all civil, family, and criminal files except the most recent criminal files which are located in the Criminal Department. All court files are open to the public except those that have been sealed by a court order. The Circuit Court case number is required to request the court file. The indexes (individual and corporation) are located in the review room inside of Central Files and date from 1967 to the present.

B. COPY AND EXHIBIT ROOM

This office makes copies for the public of papers in files at a charge of $.50 per page. All civil and family case exhibits are housed in this office. As with the files, the exhibits are open to the public except for cases sealed by order of court. The Circuit Court case number is used to request the exhibit.
