COUNTY RECEIVES FAVORABLE
JUDGEMENT FROM CIRCUIT COURT
IN LAWSUIT FILED BY LOCAL
PLUMBING COMPANY              For Immediate Release:  August 14, 1997



     Montgomery County received a favorable ruling this week in a lawsuit filed by the
Warner Management Company, Inc., against the County.  The suit, heard in Montgomery
County Circuit Court, alleged that the County violated the Maryland Public Information Act
by giving information about Warner to the news media and other third parties.  Following
trial on the liability issue, the Court found that the County did not violate the Maryland
Public Information Act. 
     While ruling in the County's favor, Judge James C. Chapin will allow attorneys for
Warner to take testimony from a witness who was unavailable for the trial.  Warner may
submit the deposition, along with a motion for a new trial, to Judge Chapin within the next
30 days.  Assistant County Attorneys Edward B. Lattner and James L. Parsons, Jr. argued the
case for the County. 
     This suit is separate from one filed by Montgomery County against the Warner
companies last June, alleging fraudulent and deceptive trade practices.
