Dear Ms. Kiddoo:

On January 25, 1999, an application for a franchise from Starpower Communications, LLC ("Starpower") was received by the Montgomery County Office of Cable Communications. Section 8A-8(i) of the Montgomery County Code, as amended, requires that the County Executive decide whether to accept or reject an application for a new overbuild franchise within ten (10) business days of its receipt. In accordance with that requirement, I am pleased to inform you that Starpower's application has been accepted, subject to the receipt of additional information concerning the technical and financial qualifications of the company.

The necessary technical information has been requested in the form of a letter from Columbia Telecommunications Corporation, the County's engineering consultant, to the Office of Cable Communications. You have been given a copy of that letter. The request for further financial information is being prepared and will be delivered to you upon its receipt from our financial consultant. Failure to provide the requested information in a timely manner may result in Starpower's application being deemed rejected.
