Defective Merchandise

 

Have you ever purchased a product from a store and when you try to use the item you find that it is defective? What are your rights? Are you stuck paying for a product that does not work?

 

No matter what a store’s return policy is, products purchased both new and used are covered by an implied warranty. An implied warranty requires that the product be in working condition at the time of sale and continue to work for a reasonable time after the purchase.

 

  • If a product is purchased and does not work for a reasonable time you can return the product, regardless of the store’s return policy.

  • If a product stops working sooner than normally expected the merchant/manufacturer is responsible for repairing the item, replacing the item, or refunding your money.

  • If the merchant/manufacturer is not willing to repair, replace, or refund your money, contact the Montgomery County Office of Consumer Protection or file a complaint with our office.
