Defective Merchandise
José went to the department store to purchase a sofa. It was delivered the next day, and he knew it was perfect for him. But, when he woke up the next morning, it had almost completely fallen apart! A salesperson from the store inspected the sofa and claimed the reason it had fallen apart was because it had a manufacturer's defect. He said they would send someone to fix it. No one ever came. So José asked the store for a refund. The store said they would give it to him, but they charged him a $78 restocking fee ... but the sofa had been damaged. They couldn't restock it! So why had they charged him that fee?
