Bill 9-12, Commission on Juvenile Justice - Membership, sponsored by the Council President at
the request ofthe County Executive was introduced on March 6,2012. A public hearing was held
on March 27, in which a representative of the Executive testified in support of the bill (©9).
Bill 9-12 would add a representative of the Montgomery County Collaboration Council for
Children, Youth and Families, a quasi-public, nonprofit organization designated as the County's
Local Management Board, as a voting member of the Commission on Juvenile Justice. The
Executive has requested this legislation because the Collaboration Council provides ongoing
support to the Commission and plays an important role in both policy development and service
delivery to the youth of Montgomery County.

Sec. 1. Section 12-36 is amended as follows:
12-36. Commission on juvenile justice; composition; appointment; terms;
vacancy.
(a)
The Commission on Juvenile Justice consists of the following [4]
classes of members:
(1)
[23] 22 voting members appointed by the County Executive,
subject to confirmation by the County Council;
(2)
[11] 12 voting members, representing each of the following: the
Council, the Executive, the State's Attorney, the Family Division
of the Circuit Court, the Police Department, the state Department
of Juvenile Justice, the County Office of the Public Defender, the
Court Appointed Special Advocate, the Department of Health
and Human Services (2 members, one representing child welfare
services and one representing community-based services for at­
risk youth), [and] the Board of Education, and the Montgomery
County Collaboration Council for Children, Youth and Families,
in each case appointed by the Executive, subject to confirmation
by the Council, after receiving a recommendation from the
person or office to be represented; and
(3)
nonvoting members emeritus, who are past members who have
given outstanding service and possess special expertise in
juvenile matters. Members emeritus may be appointed by the
Executive, subject to confirmation by the Council

DESCRIPTION:
Adds a voting member to the Commission on Juvenile Justice from
the Montgomery County Collaboration Council for Children, Youth
and Families.
The Commission currently relies on input from the Montgomery
County Collaboration Council for Children, Youth, and Families on
an informal basis in the following areas:
• information and
statistics
for
the
Commission's
work/research;
• routine updates on the success of the Detention Risk
Assessment Instrument;
• information helpful in writing the Commission's budget; and
• sharing research regarding needed services for Montgomery
County.
Establish a more formal working relationship between the
Commission on Juvenile Justice and the Montgomery County
Collaboration Council for Children, Youth, and Families. The
presence of a voting member from the Collaboration Council on the
Commission will ensure the Council's ongoing participation in the
Commission's work.

Legislation regarding the Commission on Juvenile Justice
I am sUbmitting for the Council's consideration a bill to add a representative from the
Collaboration Council for Children, Youth and Families to the Commission on Juvenile Justice. The bill
offsets this additional member by reducing the number of general voting members from 23 to 22. As a
result, the total number of voting members on the Commission remains unchanged
Since the creation of the Collaboration Council, the Commission has relied info1lIlally on
Collaboration Council staff for research and statistical data, routine updates on the Detention Risk
Assessment Instrument, expertise in policy matters, and support
in
preparing the Commission's budget.
Given the Collaboration Council's ongoing support to the Commission and the key role the Council plays
in
both policy development and service delivery to the youth of Montgomery County, it
is
appropriate
that the Collaboration Council have a voting member on the Commission on Juvenile Justice.

This legislation proposes to add one (1) voting member to the Commission on Juvenile

President Berliner, Members of the Council:
I am Michael Subin, testifying today on behalf of County Executive Isiah Leggett in
support of Bill 9-12, Commission on Juvenile Justice, Membership.
While the Bill does not add to the membership of the Commission, it changes the status
of one voting member from that of a citizen-at-Iarge to an agency member. That member
would represent the Disproportionate Minority Contact (DMC) coordinator of the
Collaboration Council, the Local Management Board. The DMC coordinator is
responsible for finding ways to decrease the proportion of minority youth who have
contact with the juvenile justice system and are detained.
It
is also the responsibility of
the DMC Coordinator to identify and address the overrepresentation of minority youth at
key points in the juvenile justice system. Of particular concern are that all youth receive
equal and fair treatment in the juvenile justice system; that all youth are provided
alternatives to secure detention; and that all County youth have access to diversion
services.
The DMC Coordinator also chairs the DMC Reduction Committee. That Committee
works in conjunction with the Department of Juvenile Services, Commission on Juvenile
Justice (CJl), the Criminal Justice Coordinating Committee (CJCC), the Montgomery
County Police Department, and various service providers to ensure fair and just treatment
for all youth, regardless of race or ethnicity.
In its close working relationship with the
cn,
the DMC Coordinator: provides the
Commission with pertinent information and statistics necessary to its work; provides
routine updates on the success of the Detention Risk Assessment Instrument (DRAI);
and, does a great deal of research to provide the most needed services for Montgomery
County juveniles. One example of the research provided by the DMC is its latest work
aimed at the establishment of an Evening Reporting Center (ERC) in Montgomery
County as a potential point of diversion. The

has often supported the work of the
Collaboration Council in their budget recommendations and hasfound the consistent flow
of information to be helpful when writing its own budget recommendations.
The work of the DMC Coordinator is critical to the work ofthe
cn
and its ability to
make recommendations to the State, the County Council, and the Executive. Passage of
this bill will formalize a relationship that, while existing, should be formalized.
