Failure to Comply With a Decision and Order​
 

The parties are hereby notified that Section 10b-13(j) of the Montgomery County Code declares that failure to comply with a decision and order of the Commission on Common Ownership Communities is punishable by a $500.00 civil fine as a Class A violation as set forth in Section 1- 19 of the Montgomery County Code. This civil fine may be imposed on a daily basis until there is compliance with this decision and order.

In addition to the issuance of a $500.00 civil fine, the Commission may also refer the matter to the Office of the County Attorney in accordance with Montgomery County Code Section 10- 13(i) for appropriate legal action.

In the event of noncompliance with any order by the deadline set forth in this decision and order, the party in whose favor the order has been issued may request enforcement of the order by submitting a “Complaint of Enforcement” to the Office of Common Ownership Communities with the Department of Housing and Community Affairs.

Any party aggrieved by the action of the Commission may file an appeal to the Circuit Court of Montgomery County, Maryland, within thirty (30) days from the date of this Order pursuant to the Maryland Rules of Procedure governing administrative appeals.
