In addition to cases for rezoning, special exceptions, and conditional uses, OZAH conducts hearings referred by other county government agencies. The transcripts for these cases are listed below.
These matters include cases referred to OZAH by the Case Review Board of the Commission on Human Rights, pursuant to Montgomery County Code §§27-7(h) and (i); cases referred to OZAH from the Commission on Common Ownership Communities pursuant to Montgomery County Code §§10B-12(d) and (e); and cases referred to OZAH from the County’s Chief Administrative Officer pursuant to the County’s Prevailing Wage Law, Code §11B-33C. In all these cases, an OZAH Hearing Examiner conducts a due process hearing pursuant to the Montgomery County Administrative Procedures Act (Montgomery County Code, Chapter 2A) and sends a Report and Recommendation to the referring agency. Cases may be referred to OZAH for a hearing by other County agencies, as well.
