What is a Common Ownership Community (COC)?

The term common ownership community includes homeowner associations, residential condominiums, and cooperative housing projects.

Who Must Register?

  • Chapter 10B of the Montgomery County Code requires that the leadership of each common ownership community register annually with the Commission on Common Ownership Communities.
  • The registration requirement does not apply to communities located within the city limits of certain incorporated municipalities. To determine if registration requirements apply, a community should contact the Commission of Common Ownership Communities unit at (240) 777-0311.

What is the COC Registration Process?

To register, the COC governing body or managing agent must send the following information to the Department of Housing and Community Affairs, Licensing and Registration,1401 Rockville Pike, 4th Floor, Rockville, MD  20852.

  1. Complete COC Registration Application

  2. Payment of Annual Registration Fees for each unit in the COC for each fiscal year the COC was built or sold

  3. Copy of current recorded governing documents

  4. Upload list of rental properties in the COC community annually

Once a community is registered, the Licensing and Registration unit automatically generates a renewal notice each year.

What are the Registered Common Ownership Communities, Board Members or Contacts?

The Department of Housing and Community Affairs (DHCA) maintains the list the registered Montgomery County Common Ownership Communities, along with their elected officials and managing agents online.  Every attempt is made to ensure the accuracy and reliability of the COC information.  However, this information is provided as a convenience "as is" without any guarantee of the accuracy, content, completeness or reliability of the information contained.  It is the responsibility of the COC to ensure the accuracy of the information and official representatives may make updates by going to the DHCA COC Registration website or contacting DHCA at 240-777-0311.

Are there Penalties for Failure to Register?

Any common ownership community that fails to register is subject to a class A violation and may have to pay civil fines as a penalty.
