Under a recent decision from the Maryland District Court, all request for transfer of liability (including stolen vehicles/tags) will be handled in court, by a judge at a hearing. Upon receipt of your court request, you will be sent a summons once a court date has been assigned.  

• If you were not the driver, to prove that you were not operating the vehicle at the time of the violation, in addition to your testimony at trial , the law requires you to provide a letter to the District Court that states that the person named in the citation was not operating the vehicle at the time of the violation. The letter must be: 

1. Sworn to or affirmed by you and
2. In the letter all corroborating evidence that the person named in the citation was not operating the vehicle at the time of the violation. You must provide the name of the driver and the address in the letter to the court after you have received your hearing notice. Please include your citation number and mark your envelope “TRANSFER OF LIABILITY.” 

• If you believe that the vehicle was being operated without your consent and was stolen, please provide a police report to the court during your hearing stating that the vehicle was stolen at the time of the occurrence.  

• If this citation involves a Class E, Class F or a Class P vehicle, please follow the instructions on the back of the citation and send the required information as soon as you receive a summons.
