MCEO 243-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Bethesda.  INSTALL No Parking 9AM - 6PM Monday - Friday on southwest side of Merivale Rd from Murray Rd. to Andover Rd., Permit Parking Only 9AM - Monday - Friday Brookdale on the northeast side of Merivale Rd. from Andover Rd. to Westport Rd.  Effective Date:  11/03/04. 

 

MCEO 244-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Public Hearing for Abandonment of a Portion of Cameron Street Air Rights, Silver Spring, Maryland.  A public hearing was held at 10:30 a.m. on Wednesday,  November 3, 2004, at 101 Monroe Street in the EOB Lobby Auditorium, Rockville, Maryland 20850 to consider an application, on behalf of United Therapeutics Corporation, seeking abandonment of a portion of the air rights associated with the Cameron Street right-of-way at the intersection with Spring Street in Silver Spring adjoining the applicant's property.  The hearing officer shall report his findings and recommendations to the County Executive for further consideration as prescribed by County Code. Effective Date:  11/02/04. 

 

MCEO 245-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Daniel P. O'Donnell and Jeanette D. O'Donnell, Fairland Road Improvements - CIP 500402.  The option contract between Daniel P. O'Donnell and Jeanette D. O'Donnell, and Montgomery County, Maryland, for the purchase of land and granting of easements for the referenced project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land and easements.  Effective Date: 11/05/04. 

 

MCEO 246-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Harpal Singh and Rene Juneja, Fairland Road Improvements - CIP 500402.  The option contract between Harpal Singh & Rene Juneja and Montgomery County , Maryland for the purchase of land and granting of easements for the referenced project is hereby accepted. The County Attorney is hereby directed to take all necessary steps to acquire the land and easements.  Effective Date:  11/05/04.   

 

MCEO 247-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Ernest Williams, Jr. and Maria Williams, Fairland Road Improvements - CIP 500402.  The option contract between - Ernest Williams, Jr. and Maria Williams and Montgomery County, Maryland for the purchase of land and granting of easement for the above referenced project is hereby accepted. The County Attorney is hereby directed to take all necessary steps to acquire the land and easements. Effective Date:  11/09/04.

 

MCEO 248-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - CIP Project No. 509274 - Robey Road, The Vineyards Condominium - Two (2) Option Contracts.  The two option contracts between  (1) Elizabeth G. Caldwell, and (2) Robert A. & Michelle A. Schilke and Montgomery County, Maryland for acquiring each of their varying interests in the easement acquisitions for the Robey Road project are hereby accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the easement. Effective Date:  11/09/04.

 

MCEO 249-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order -- Bethesda.  REMOVE:  Unlimited Metered Parking (No Signs) on east side of Tuckerman Ln. from 100' north of Montrose Ave.  to 616' north of Montrose Ave., No Parking Any Time from 616' north of Montrose Ave. to 76' north of Strathmore Park Ct.; INSTALL:  Unlimited Metered Parking (No Signs) on east side of Tuckerman Ln. from 100' north of Montrose Ave. to 575' north of Montrose Ave., No Parking Any Time from 575' north of Montrose Ave. to 76' north of Strathmore Park Ct.   Effective Date:  11/08/04.

MCEO 252-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of a Portion of 20-Foot Alley, Block B., Wheaton Forest Subdivision, Wheaton, Maryland.  A public hearing was held on Wednesday, December 8, 2004, 101 Monroe Street, EOB Lobby Auditorium, Rockville, Maryland  20850 to consider an application received on behalf of a partnership of the
Housing Opportunities Commission, Washing Metropolitan Area Transit Authority, and Bozzuto Development Company seeking abandonment of a portion of a 20-foot alley in Block B., Wheaton Forest subdivision south of Reedie Dr. in Wheaton.  After the public hearing, the hearing officer shall report his findings and recommendations to the County Executive for further consideration as prescribed by County Code.  Effective Date:  11/10/04.

 

MCEO 253-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Rockville.  REMOVE:  Permit Parking Only 7:00AM - 5:00PM School Days, Hoover Middle School on southeast side of Postoak Rd. from 212' north of Tuckerman Ln. to 385' north of Tuckerman Ln.; INSTALL:  No Stopping School Days 7:30AM - 4:00PM on southeast side of Postoak Rd. from 212' north of Tuckerman Ln. to 385' north of Tuckerman Ln..  Effective Date:  11/10/04. 

 

MCEO 254-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  REMOVE:  No Parking Any Time on northwest side of East Franklin Ave. from Merwood Ln. to University Blvd., from 60' east of University Blvd. to University Blvd. , from Merwood Ln. to University Blvd.  Effective Date:  11/10/04

 

MCEO 255-04:  DEPARTMENT OF PERMITTING SERVICES - Street Acceptance.  This order certifies that construction of the following named streets has been completed in accordance with all applicable provisions of the Montgomery County Road Construction Code as specified in the permit.  The materials used in the construction of these streets were tested and found to be in compliance with county specifications.  Thistlebridge Dr., Thistlebridge Way, Arbor Crest Way  (Small's Nursery), Brown Farm Ct., Brown Farm Way, Sapling Ridge Ln.,  (Denit  Estates), Broken Oak Rd., (Seneca View Estates), Morningside Dr. (Jacksons Acres), Manor Spring Ter. (Manor Spring West), Unicorn Way (Willow Oaks), Natia Manor Dr., Ramsburg Ct. (Natalie Estates).    Effective Date:  11/17/04. 

 

MCEO 256-04:  DEPARTMENT OF FIRE AND RESCUE SERVICE - Employee Solicitation Waiver.  Pursuant to the Montgomery County Public Ethics Law, the County Executive authorizes the Fire Administrator and the successor Fire Chief to designate employees assigned to Montgomery County Fire and Rescue Service to solicit gifts, donations and in-kind services for the benefit of Women in the Fire Service, Inc. for the period of November 2004 to November 2005 in accordance with the requirements established by this Executive Order.  The Fire Administrator or successor Fire Chief must publicly acknowledge each gift by placing a notice in the Montgomery County Register indicating the gift donated, the identity of the donor, the identity of the recipient of the gift and the purpose for which the gift will be used.  Effective Date:  11/22//04.
 

MCEO 257-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Condemnation Authorization - Roselea Crivella et al, South Silver Spring Linkages, CIP No. 760400.  Whereas plans for South Silver Spring Linkages state that the property owned by Roselea Crivella et al, is needed for the project; and Montgomery County and the owners of said property have been unable to agree upon a sum to be paid for the property; and Montgomery County may institute condemnation proceedings under Section 49-46 of the Montgomery County Code 1994, as amended; the County Attorney is directed to acquire by condemnation the listed property which is needed for the South Silver Spring Linkages project, Capital Improvements Program Project No. 760400.  Effective Date:  11/22/04.

 

MCEO 260-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Park Lane Improvement.  Pursuant to the Montgomery County Code 1994 as amended, the County Executive finds that public interest requires the construction of Park Lane located within the Bethesda Chevy Chase Planning area, and the Department of Public Works and Transportation is hereby authorized to proceed with the construction (1) the reconstruction of Park Lane as a new two plane closed section roadway between Maple Ridge Rd and Battery Lane, (2) improvements to Park Lane and sections of Battery Lane including new storm drain systems to provide relief from roadway flooding, replacement of damaged paving, new curb and gutter and sidewalk reconstruction where needed.  The project was approved by the hearing examiner after a public hearing held September 22, 2004, and the expenditures authorized by this order plus expenditures accrued to date shall not exceed $1,793,000.00 and made payable from funds appropriated for CIP No. 500508.  Effective Date:  11/23/04.

MCEO 262-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Rockville.  This order directs DPWT to install and/or parking control devices at the designated locations.  INSTALL:  No Parking Any Time on Country Creek Ln. adjacent to the island in the center of the cul-de-sac.  Effective Date:  10/26/04.

 

MCEO 263-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  INSTALL:   on the south side of Century Blvd. in two locations from Middlebrook Rd. to 305' east of same, in 3 locations between 390' east of Middlebrook Rd. and 365' east of Town Commons Drive/Safeway driveway, from 610' east of Town Commons Drive/Safeway driveway to Pinnacle Dr., in two locations east on Pinnacle Dr. to 280' east of same, from 380' east of Pinnacle Dr. to Crystal Rock Dr., on north side of Century Blvd. at 2 locations between Crystal Rock Dr. and 290' west of the same, from 415' west of Crystal Rock Dr. to Pinnacle Dr., in 2 locations between Pinacle Dr. and 425' west of same, from point 625' west of Pinnacle Dr. to Town Commons Drive/Safeway driveway, in 2 locations between Town Commons Dr./Safeway driveway and 155' west of Town Commons/Safeway driveway, from 215' west of Town Commons Dr./Safeway driveway to Middlebrook Rd.  Effective Date:  11/28/04.

 

MCEO 264-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  This order directs DPWT to erect and/or remove the following traffic control devices establishing those streets or parts of street described as through streets, thereby granting right-of-way to traffic on said streets or parts of street at all intersecting streets.  Effective Date:  11/28/04.

 

MCEO 271-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - MD 190/River Road Sidewalk (CIP #506747).  A public hearing will be held at 4:00 p.m. on Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 101 Monroe St. in Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the north side of MD190/River Rd. from Rising Ridge Rd. to Seven Locks Rd. located in Bethesda, Maryland.  Being proposed is a concrete sidewalk on the north side of MD109/River Rd. from Rising Ridge Rd. to Seven Locks Road .  The sidewalk will be five feet wide and will conform to ADA requirements.  The total length of the sidewalk is 850 linear feet.  MD109/River Rd. is classified as a major roadway and has a variable width public right-of-way.  There is approximately 70' of available public right-of-way on the north side of River Rd.  If approved as listed by the County, expenditures authorized by this order plus expenditures accrued to date for this project shall not exceed $32,725.00 and shall be made payable from funds appropriatedfor CIP Project No. 506747.  Effective Date:  12/06/04.

 

MCEO 272-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - US 29/Colesville Road Sidewalk (CIP 506747).  A public hearing will be held at 4:30 p.m. on Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 101 Monroe St. in Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the west side of US 29/Colesville Rd. from St. Andrews Way to 9316 Colesville Rd. located in Silver Spring, Maryland.  A concrete sidewalk would be built on the west side of US 29/Colesville Rd.  The sidewalk will be five feet wide and will conform to the ADA requirements with a total length of 615 feet.  Seven adjacent property owners have been notified of this hearing.  Effective Date:  12/06/04. 

 

MCEO 273-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Silent Valley Ln. - Dufief Dr. Sidewalk (CIP 506747).  A public hearing will be held at 3:00 p.m. on Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 1101 Monroe St. in Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the (a) north side of Silent Valley Ln. from Happy Choice Ln. to 11605 Silent Valley Ln. and (b) both sides of Dufief Dr. from Darnestown Rd. to 400' south, located in Gaithersburg, Maryland.  A concrete sidewalk scheduled to be built will be 4 feet wide and will conform to the ADA requirements.  The total length of the sidewalks is 1100 linear feet.  Silent Valley Ln. is classified as a secondary residential roadway with a 60 foot public right of way and on street parking is allowed on both sides.  Dufief Dr. is classified as a primary residential roadway with a 70 foot public right of way.  The existing roadway is approximately 24 feet wide and has on street parking on both sides.  Ten adjacent property owners have been notified of this public hearing.  Effective Date:  12/06/04.

 

MCEO 274-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Hampden Lane Sidewalk (CIP #506747).  A public hearing will be held at 3:30 p.m. Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 101 Monroe St. in Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the north side of Hampden Ln. from Exeter Rd. to 5211 Hampden Ln. located in Bethesda, Maryland.  A concrete sidewalk will be built  under the Capital Improvement Project 506747 (Annual Sidewalk Program).The sidewalk will be 4 feet wide, will conform to the ADA requirements and the total length of the sidewalk is 350 linear feet.  Hampden Ln. is classified as a secondary residential roadway and has a 50 foot public right-of-way. Seven property owners have been notified of the public hearing.  Effective Date:  12/06/04.

 

MCEO 275-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Fernshire Road Sidewalk (CIP #506747).  A public hearing will be held at 5:00 p.m. Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 101 Monroe St. in Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the north side of Bayswater Rd. from Horn Point Dr. to Fernshire Rd. located in Gaithersburg, Maryland.  A concrete sidewalk will be built  under the Capital Improvement Project 506747 (Annual Sidewalk Program).The sidewalk will be 4 feet wide, will conform to the ADA requirements and the total length of the sidewalk is 500 linear feet.  Fernshire Rd. is classified as a secondary residential roadway, has a 60 foot public right-of-way and on street parking is allowed on both sides of Fernshire Rd.  Five property owners have been notified of this public hearing.  Effective Date:  11/28/04.

 

MCEO 276-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Bayswater Road Sidewalk (CIP #506747).  A public hearing will be held at 5:30 p.m. Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 101 Monroe St. in Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the north side of Bayswater Rd. from Horn Point Dr. to Fernshire Rd. located in Gaithersburg, Maryland.  A concrete sidewalk will be built  under the Capital Improvement Project 506747 (Annual Sidewalk Program).The sidewalk will be 4 feet wide, will conform to the ADA requirements and the total length of the sidewalk is 2,300 linear feet.  Bayswater Rd. is classified as a secondary residential roadway, has a 60 foot public right-of-way and on street parking is allowed on both sides of Bayswater Rd.  Twenty seven property owners have been notified of this public hearing.  Effective Date:  2/06/04.  MCEO 284-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with James H. Williams and Jean F. Williams Fairland Road Improvements Project CIP Project No. 500402.  The option contract between James H, Williams and Montgomery County, Maryland for the purchase of land and granting of easement for the Fairland Road Improvements Project is accepted.  Executive Order No. 258-04 is being rescinded because the names were supposed to be listed as James H. and Jean F. Williams not Ernest and Maria Williams.  Effective Date:  12/03/04.

 

MCEO 283-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of a Portion of Ronald Dr., Potomac, Maryland.  A public hearing was held at 10:30 a.m. on Monday, December 13, 2004, at 101 Monroe Street, EOB Lobby Auditorium, Rockville, Maryland  20850 to consider an application from Ahmad and Mahtab Habibi, seeking abandonment of a portion of unimproved Ronald Dr. as it adjoins Falls Rd. in Potomac.  The hearing officer shall report his findings and recommendations to the County Executive for further consideration as prescribed by County Code.  Effective Date:  12/10/04.

 

MCEO 284-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with James H. Williams and Jean F. Williams Fairland Road Improvements Project CIP Project No. 500402.  The option contract between James H, Williams and Montgomery County, Maryland for the purchase of land and granting of easement for the Fairland Road Improvements Project is accepted.  Executive Order No. 258-04 is being rescinded because the names were supposed to be listed as James H. and Jean F. Williams not Ernest and Maria Williams.  Effective Date:  12/03/04.
