MCEO NO. 34-06:  FIRE AND RESCUE SERVICE - Fire Lane Establishment.  This order is notification of the establishment of a fire lane at the French International School, 9600 Forest Road.  The department is hereby ordered to post fire lane signs and paint curbs/pavement (painting optional) in the location listed above.  When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials.  Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign.  The fine for parking in a fire lane is $250.00.  Effective Date:  2/28/06.

 

MCEO NO. 36-06:  DEPARTMENT OF PERMITTING SERVICES - Street Acceptance.  (Number and Department correction from the March 1, 2006 Register.)  This is to certify that construction of the following named streets has been completed in accordance with County Road Construction Code as specified in the permit.  The materials used in the construction of these streets were tested
and found to be in compliance with county specifications.  The streets are as follows:  Bubbling Spring Rd. (King's Crossing), Traville Gateway Dr., (Traville), Alpenhorn Way, Schubert Dr.(Tanglewood), Bear Creek Dr., Black Kettle Dr., Fable Dr. (Hoyles Mill Village).  Effective Date: 2/09/06.

 

MCEO NO. 37- 06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Silver Spring Library - CIP No. 508768.  The option contract between the Estate of Nabiha J. Saah, George Saah as personal representative, and Montgomery County, Maryland, for the purchase of land and improvements for the Silver Spring Library project, is accepted.  The County Attorney is directed to take all necessary steps to acquire the land and improvements.  Effective Date:  2/09/06.

MCEO NO. 41-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - DPWT is directed to change the following traffic and/or parking control devices at the designated locations.  Rescind all traffic regulations including traffic order 153-88 on northbound Overhill Rd. at Lambeth Rd.; INSTALL Stop on northbound Overhill Rd. at Lambeth Rd.  Effective Date:  2/15/06.

 

MCEO NO. 42-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Bethesda Bikeways (CIP 500119).  The County Executive finds that it is in the public interest to provide bikeway and pedestrian improvements along locations in Bethesda, Maryland.  Some of the improvements will be at the intersection of Bethesda Ave. and Woodmont Ave. and will include expanding the existing pedestrian refuge island, a 510 square foot area bump-out on northwest corner of Bethesda Ave./Woodmont Ave.; expansion of crosswalks to 16' wide; expansion of handicap ramps to 6' wide landings; modifications to existing traffic signal to accommodate the new crossing distances.  Improvements to Norfolk Ave. between Rugby/Glenbrook Avenues to Woodmont Ave.

will include intersection bump-outs at the following intersecting streets with Woodmont Ave:  Rugby Ave./Glenbrook Ave; Auburn Ave; Del Ray Ave; Cordell Ave; St. Elmo Ave.; Fairmont Ave.; and will modify the existing traffic signals with provisions for Pedestrian Countdown Timers.  A public hearing was held on the project on Thursday, October 27, 2005, in the lobby level auditorium of the Executive Office Building and the hearing examiner recommended approval of the project.  The total estimated cost of the project will be $768,373.00.  Effective Date:  2/16/06.

 

MCEO NO. 43-06:  OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition.  The County Executive has determined that acquisition of the Rickman Horse Farm is necessary as parkland.  This was decided after a public hearing held on January 26, 2006, and it was approved for acquisition in the "FY 06 Capital Budget."  Therefore the County Attorney is directed to acquire by purchase or condemnation the Rickman Horse Farm.  Effective Date:  2/23/06.

 

MCEO NO. 44-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of 10-foot Path, Hendry Estates Subdivision, Bethesda.  There was a public hearing held at 10:30 AM on March 2, 2006, at 101 Monroe Street, EOB, 10th Floor Large Conference Room, Rockville, Maryland,  20850, to consider an application received from Bulman Dunie, Burke & Feld on behalf of its clients, John A. Moore III and Brianna M. Moore, seeking abandonment of a portion of an unimproved 10-foot path adjoining their property, Hendry Estates subdivision in Bethesda.  The hearing officer will report his findings and recommendations to the County Executive for further consideration as prescribed by County Code.  Effective Date:  2/22/06.

 

MCEO NO. 45-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of a Portion of Legion Dr., Damascus, Maryland.  A public hearing was held on Thursday, February 23, 2006, to consider an application received from Joseph Mullaney, Danial and Kelly Sennewalk, and Richard Redman, seeking the abandonment of a portion of unimproved Legion Dr. in Damascus.  The hearing examiner will present his findings and recommendations to the County Executive for further consideration as prescribed by the County Code.  Effective Date:  2/22/06.

 

MCEO NO. 46-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - N. Potomac Community Recreation Center - CIP No. 500152.  The option contract between James W. Salter, III, Trustee for  Joyce Ann Achambault and David M. Garber, and Montgomery County, Maryland, for the purchase of land for the North Potomac Community Recreation Center is accepted.  The County Attorney is directed to take all necessary steps to acquire the land and easements.  Effective Date:  2/22/06.

 

MCEO NO. 47-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION -Park Lane Storm Drain - CIP Project No. 500508.  The option contract between Joaquin Paez and Socorro de Paez and Montgomery County for the granting of an easement for the Park Lane Storm Drain project is accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the easement.  Effective Date:  2/22/06.

 

MCEO NO. 48-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Faith Methodist Church of Montgomery County has executed an easement for the right of way to the Washington Suburban Sanitary Commission (WSSC) needed for WSSC to relocate a fire hydrant onto the Church's property, in conjunction with the construction of Montrose Parkway.  Montgomery County is requiring the relocation of the facility and is agreeable to paying for the easement necessary for the relocation of the hydrant.  Effective Date:  2/22/06.

 

MCEO NO. 49-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Muncaster Road - CIP No. 509943.  The option contract between Darold R. Patterson, Maria S. Patterson, and Montgomery County, Maryland, for the purchase of land and granting of easements for the Muncaster Road Project is accepted.  The County Attorney is directed to take all necessary steps to acquire the land and easements.  Effective Date:  2/22/06.

 

MCEO NO. 50-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Neelsville Church Road Sidewalk (CIP 50674).  A pubic hearing will be held at 3:00 pm on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe St., Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the west side of Neelsville Church Road from Church Bend Court to Scenery Drive located in Germantown, Maryland.  A 4' wide concrete sidewalk is planned and will conform to the ADA requirements.  The sidewalk will be 1170 linear feet long.  Neelsville Church Rd. is a secondary residential roadway and has 80' of public right-of-way on the west side.  The sidewalk will be constructed with a varying amount of greenspace.  The estimated cost of the sidewalk is $60,500.00.  Effective Date:  2/22/06.

 

MCEO NO. 51-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Hornbeam Drive and Sycamore Lane Sidewalk.  A public hearing will be held at 3:30 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the south side of Hornbeam Dr. from Sycamore Ln. to the Flower Valley Park Entrance and west side of Sycamore Ln. from Hornbeam Dr. to Muncaster Mill Rd. located in Rockville, Maryland.  A 4 foot wide concrete sidewalk is planned which will conform to the ADA requirements.  The sidewalk will be 1300 linear feet long and Hornbeam Dr. classified as a secondary residential roadway, has 60' of public right-of-way.  The present road is 20' wide with 20' of available public-right-of way along the south side.  The total length of the sidewalk along Sycamore Ln. is 650'.  It will be constructed with a varying amount of greenspace.  The estimated cost of the sidewalk is $63,600.00.  Effective Date:  2/22/06.

 

MCEO NO. 52-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Pearl Street Sidewalk (CIP #506747).  A public hearing will be held at 4:30 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the west side of Pearl St. from Our Lady of Lourdes Catholic Church to Sleaford Dr. located in Bethesda.  The 4 foot wide concrete sidewalk will conform to ADA requirements.  The total length of the sidewalk is 625 linear feet.  Pearl Street is classified as a secondary residential roadway and has a 50' public right-of-way.  It is 23' wide with 15' of available public right-of-way along the west side of Pearl St.  The sidewalk will be constructed at the edge of new concrete curb.  Estimated cost for the project is $66,700.00.  Effective Date 2/22/06.

 

MCEO NO. 53-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Newport Mill Road Sidewalk (CIP #506747).  A public hearing will be held at 4:00 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the west side of Newport Mill Road from the existing sidewalk at 11604 Newport Mill Road to Veirs Mill Road, located in Wheaton, Maryland.  A 4 foot wide concrete sidewalk is planned which will conform to the ADA requirements.  The total length of the sidewalk is 190 linear feet.  Newport Mill Road is classified as a primary residential roadway and has a 60' public right-of-way.  The roadway is 30' wide with approximately 15' of available public right -of-way along the west side of Newport Mill Rd.  The sidewalk will be constructed with varying greenspace.  The estimated cost of the total proposed improvement is $27,700.00.  Effective Date:  2/22/06.

 

MCEO NO. 54-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Nickelby Drive and Bloom Drive Sidewalk (CIP #506747).  A public hearing will be held at 5:00 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the south side of Bloom Drive from Ridge Road to Nickelby Drive and the west side of Nickelby Drive from Bloom Drive to Cutsail Road located in Damascus.  A 4 foot wide concrete sidewalk is planned and will conform to the ADA requirements.  The total length of the sidewalk along Bloom Dr. is 495 linear feet and Bloom Dr. is classified as a business district roadway with a 60' public right-of-way.  The roadway on Bloom Dr is 26' wide with approximately 17' of available public right-of-way along the south side of Boom Drive.  The total length of the sidewalk along Nickelby Drive is 1600 linear feet.  Nickelby Drive is classified as a secondary residential roadway and has a 60 foot public right-of-way.  The road is 26' wide with approximately 17' of available public right-of-way along the west side of Nickelby Drive.  The sidewalk will be constructed with varying greenspace.  The total estimated cost of this project is $52,100.00.  Effective Date:  2/22/06.

 

MCEO NO. 55-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Forest Glen Road Bikeway.  A public hearing will be held at 5:30 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland, to consider a proposal to provide safe pedestrian and bicycle travel along the south side of Forest Glen Road from Georgia Ave. to the Sligo Creek Trail, located in Silver Spring, Maryland.  An asphalt bikeway is proposed to replace the existing concrete sidewalk.  The bike path will vary from 6' to 8' in width and will conform  to ADA requirements.  The total length of the bike path along Forest Glen Rd. is 2,540 linear feet.  Forest Glen Rd. is classified as an arterial roadway and has an 80 foot public right-of-way.  The road is 24' wide and has approximately 30' of available public right-of-way on the south side of Forest Glen Road from Georgia Ave. to the Sligo Creek Train.  The bikeway will be constructed with a varying greenspace.  The total estimated cost of this project is $135,500.00.  Effective Date:  2/22/06.

 

MCEO NO. 56-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order Gaithersburg.  DPWT is ordered to change the following traffic and/or parking control devices at the designated locations:  REMOVE Stop on Club House Rd. at Watkins Mill Rd. so as to stop westbound traffic on Club House Rd.; INSTALL Three-Way Stop at the intersection of Club House Rd. and Watkins Mill Rd.  Effective Date:  1/30/06.

 

MCEO NO. 57-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Gaithersburg.  DPWT is directed to erect and/or REMOVE the following traffic control devices establishing those street or parts of street described in the schedule as through streets, thereby granting right-of-way to traffic on said streets or parts of street at all intersecting streets.  REMOVE traffic control from Traffic Order 117-78 on Watkins Mill Rd. from Blunt Road to Stedwick Road; INSTALL traffic control on Watkins Mill Rd. from Blunt Rd. to Apple Ridge Rd., on Watkins Mill Road from Apple Ridge Road to Club House Rd.  Effective Date:  1/30/06.

 

MCEO NO. 58-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION  - Traffic Order - Wheaton/Glenmont.  INSTALL No Parking Any Time on south side of Cannon Dr. from Autumn Dr. to eastern most property line of 13103 Autumn Dr.  Effective Date:  2/17/06.

 

MCEO NO. 59 06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION -Traffic Order - Silver Spring.  REMOVE No Thru Trucks or Buses Over 7,000 lb. GVW; INSTALL No Thru trucks Over 7000 GVW on east bound Thayer Ave. at Grove St.  Effective Date:  2/20/06.

 

MCEO NO. 60-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Wheaton/Glenmont.  INSTALL No Right Turn 7 AM 7:30 AM for westbound traffic on Norwood Rd. at Attleboro Road.  Effective Date:  2/23/06.

 

MCEO NO. 61-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  REMOVE No Thru Trucks over � Ton on Ritchie Ave. between Sligo Ave. and Piney Branch Road; INSTALL No Thru Trucks Over 7,000 lb. GVW on Ritchie Ave. from Sligo Ave. to Piney Branch Rd.  Effective Date:  2/20/06.

 

MCEO NO. 62-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  INSTALL No Parking Any Time on north side of Elton Rd. from 25' east of driveway for 1710 Elton Rd. to 25' west of the driveway for 1710 Elton Rd., on north side of Elton Rd. from 68' west of the driveway for 1710 Elton Rd. to 168' west of the driveway for 1710 Elton Effective Date:  2/23/06.

 

MCEO NO. 63-06:  DEPARTMENT OF TECHNOLOGY SERVICES/OFFICE OF CABLE AND COMMUNICATIONSERVICES - Set Cable Television Rates Pursuant to FCC Form 1240.  This is an order from the County Executive setting cable television rates for the basic service tier pursuant to FCC for 1240 filed April 1, 2005.  Effective Date:  3/16/06.

MCEO NO. 65-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  DPWT is directed to erect and/or remove the following traffic control establishing those streets or parts of street as through streets, thereby granting right-of-way to traffic on said streets or parts of street at all intersecting streets.  INSTALL traffic control on Snowden Farm Parkway from Stringtown Rd. to Ridge Rd.  Effective Date:  2/24/06.

 

MCEO NO. 66-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  REMOVE Yield on Fox Field Circle/Stage Coach Dr. at Manor View Circle; INSTALL Stop on Fox Field Circle/Stage Coach Dr. at Manor View Circle.  Effective Date:  2/24/06.

 

MCEO NO. 67-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION PUBLIC WORKS AND TRANSPORTATION - Abandonment of Portion of Willowbrook Dr., Kentsdale Estates, Potomac.  A public hearing was held at 10:30 AM on Thursday March 23, 2006, at 101 Monroe Street, EOB, 10th Floor, Large Conference Room, Rockville, Maryland  20850 to consider an application received from Linowes and Blocher on behalf of its clients, Vasawani Place Corporation, Trustees of Potomac Hills Trust 1 and Sonina Properties, LLC, Trustee of Potomac Hills Trust 2 (the applicants) seeking abandonment of a portion of unimproved and improved Willowbrook Dr. in the Kentsdale Estates subdivision in Potomac.  The hearing officer will report his findings and recommendations to the County Executive for further consideration as prescribed by County Code.  Effective Date:  3/01/06.

 

MCEO NO. 68-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - CIP Project No. 500403 Stringtown Road, Condemnation Authorization.  Montgomery County needs to acquire a real property interest from the Farm Development COOP, LLC property, in connection with the Department of Public Works and Transportation, Stringtown Rd. project, CIP Project No. 500403.  The County and the owners of said property have been unable to agree upon a sum to be paid for the property, and Montgomery County may institute condemnation proceedings under Section 49-46 of the Montgomery County Code 2004.  Therefore the County Attorney is directed to acquire by condemnation the property needed by the County for the Stringtown Road project.  Effective Date:  3/06/06.

 

MCEO NO. 69-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Rockville.  INSTALL No Parking Any Time on both sides of Cadbury Ave. from Seven Locks Rd. to Ansin Circle Dr., on both sides of the median on Cadbury Ave. from Seven Locks Rd. to Ansin Circle Dr.  Effective Date:  3/05/06.

 

MCEO NO. 70-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Wheaton/Glenmont.  INSTALL Right Turn Yield to U-Turn on Red for southeast bound traffic on Norwood Rd. at New Hampshire Ave.  Effective Date:  3/06/06.

 

MCEO NO. 71-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  INSTALL Stop on eastbound Seibel Dr. at Timberlake Dr.  Effective Date:  3/05/06.

 

MCEO NO. 72-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Wheaton/Glenmont.  INSTALL Four-Way Stop at the intersection of Hillcrest Ave. and Olney Shopping Center Driveway to property #18201.  Effective Date:  3/05/06.

 

MCEO NO. 73-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  DPWT is directed to install traffic control establishing those streets or parts of street as through streets, thereby granting right-of-way to traffic on said streets or parts of street at all intersecting streets.  Install traffic control device on Skylark Rd. from Ridge Rd. to Piedmont Rd.  Effective Date:  3/05/06.

 

MCEO NO. 74-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION Traffic Order - Germantown.  INSTALL Stop for northwest bound traffic on Linden Vale Dr. at Cherry Branch Dr., for westbound traffic on Tall Poplar Dr. at Cherry Branch Dr., for southeast bound traffic on Linden Vale Dr. at Persimmon Ridge Rd., for southeast bound traffic on Tall Poplar Dr. at Persimmon Ridge Rd., on Cherry Branch Dr. at Persimmon Ridge Rd. MCEO NO. 103-06:  OFFICES OF THE COUNTY EXECUTIVE - Senior Citizen Fire Safety Task Force.  Because studies have shown that senior citizens - presently the fastest growing population - are especially at risk from fire dangers, the Senior Citizen Fire Safety Task Force was established as an executive committee on March 24, 2006.  This task force will advise the Executive and Fire Chief on procedures designed to reduce the risk of fire-related deaths and injuries to senior citizens in the County.  The task force will consist of 25 members appointed by the Executive and representing persons of diverse social, cultural, and economic backgrounds, and ex-officio members from designated public agencies.  Effective Date:  3/24/06.
