The
Office of Human Resources (OHR), Class and Compensation Division, requested that the Office of Labor Relations assess, evaluate, and issue determinations concerning the bargaining unit status of the following two (2) Office, Professional, and Technical (OPT) unit positions, as defined by Section 33-105(a)(2)(A) – (D) of the Montgomery County Code (hereinafter, “Code”), Alcohol Beverage Services (ABS), Administrative Services Division:

 
Administrative Specialist II
Grade 21
Class Specification No. 000151
Position Nos. 007004 and 007124
 
In accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relations Officer (hereinafter, “CLRO”) has determined that the ABS, Administrative Services Division, Administrative Specialist II, Grade 21 position, Nos. 007004 and 007124, are appropriately included in the bargaining unit pursuant to Code Section 33-102(4) and, consistent therewith, do not fall under any of the exceptions set forth in Section 33-102(4)(A) – (Q) that would compel exclusion from the unit.
 
Any individual or agent of the certified bargaining representative may file an objection to this determination with the Labor Relations Administrator, with notice to the Chief Labor Relations Officer, within 10 days of the publication of this notice:

The Office of Human Resources (OHR), Class and Compensation Division, requested that the Office of Labor Relations assess, evaluate, and issue a determination concerning the bargaining unit status of the following Office, Professional, and Technical (OPT) unit position, Department of Finance (hereinafter, “Department”), Division of Risk Management:
 
Administrative Specialist III
Grade 23
Class Specification No. 000150
Position No. 000580                                                                                                                                   
 
OHR submitted the above-referenced request based on the substantial accretion of Human Resources-related duties specific to this, particular Administrative Specialist III, Grade 23 position, No. 000580, and to the long-standing incumbent thereof, which/who resides in the Department’s Division of Risk Management. The position title is “Workers’ Compensation Coordinator”, and, in the role, the position/incumbent performs significant Human Resources-related functions and, in that vein, handles and is privy-to otherwise confidential employee information (including medical and health-related information necessary to evaluate and process employee workers’ compensation claims).
 
In accordance with the Montgomery County Code, sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note), and based on the substantial accretion of Human Resources-related duties, the Chief Labor Relations Officer has determined that Position No. 000580 is appropriately excluded from the OPT bargaining unit pursuant to Code Section 33-102(4)(G)(vii)(which specifically excludes from the bargaining unit an “employee who works for the Office of Human Resources.”).

In July 2023, the Department of Health and Human Services (hereinafter, “Department”) requested that the Office of Labor Relations review, assess, and issue a determination regarding the bargaining unit status of the following Office, Professional, and Technical (OPT) unit position:
 
Program Manager II
Grade 25
Class Specification No. 000832
Position No. 015779
 
The Department submitted the above-referenced request based on the accretion of supervisory duties specific to this Program Manager II, Grade 25 position, No, 015779, which resides in the Department’s Office of Eligibility and Support Services, Children, Youth, and Family Services Division. In acknowledgement of the supervisory duties that had/have accreted to Position No. 015779, the Department proposed to the Office of Human Resources (“OHR”) – and OHR later approved -- that the associated position description be updated accordingly. Importantly, the accreted supervisory duties includes/ed, among other duties, directing the work of eight (8), subordinate positions.
 
In accordance with the Montgomery County Code, sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note), and based on the accretion of supervisory duties and the updated position description, the Chief Labor Relations Officer has determined that Position No. 015779 is appropriately excluded from the OPT bargaining unit, pursuant to Code Section 33-102(10)(A) – (C); specifically, Section 33-102(10)(B), which defines “Supervisor” as “an employee who has the authority to direct the activity of 3 or more employees.”
