MCEO 256-04:  DEPARTMENT OF FIRE AND RESCUE SERVICE - Employee Solicitation Waiver.  Pursuant to the Montgomery County Public Ethics Law, the County Executive authorizes the Fire Administrator and the successor Fire Chief to designate employees assigned to Montgomery County Fire and Rescue Service to solicit gifts, donations and in-kind services for the benefit of Women in the Fire Service, Inc. for the period of November 2004 to November 2005 in accordance with the requirements established by this Executive Order.  The Fire Administrator or successor Fire Chief must publicly acknowledge each gift by placing a notice in the Montgomery County Register indicating the gift donated, the identity of the donor, the identity of the recipient of the gift and the purpose for which the gift will be used.  Effective Date:  11/22//04.

MCEO 257-04: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Condemnation Authorization - Roselea Crivella et al, South Silver Spring Linkages, CIP No. 760400. Whereas plans for South Silver Spring Linkages state that the property owned by Roselea Crivella et al, is needed for the project; and Montgomery County and the owners of said property have been unable to agree upon a sum to be paid for the property; and Montgomery County may institute condemnation proceedings under Section 49-46 of the Montgomery County Code 1994, as amended; the County Attorney is directed to acquire by condemnation the listed property which is needed for the South Silver Spring Linkages project, Capital Improvements Program Project No. 760400. Effective Date: 11/22/04.

MCEO 260-04: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Park Lane Improvement. Pursuant to the Montgomery County Code 1994 as amended, the County Executive finds that public interest requires the construction of Park Lane located within the Bethesda Chevy Chase Planning area, and the Department of Public Works and Transportation is hereby authorized to proceed with the construction (1) the reconstruction of Park Lane as a new two plane closed section roadway between Maple Ridge Rd and Battery Lane, (2) improvements to Park Lane and sections of Battery Lane including new storm drain systems to provide relief from roadway flooding, replacement of damaged paving, new curb and gutter and sidewalk reconstruction where needed. The project was approved by the hearing examiner after a public hearing held September 22, 2004, and the expenditures authorized by this order plus expenditures accrued to date shall not exceed $1,793,000.00 and made payable from funds appropriated for CIP No. 500508. This order directs DPWT to erect and/or remove the following traffic control devices establishing those streets or parts of street described as through streets, thereby granting right-of-way to traffic on said streets or parts of street at all intersecting streets. MCEO 271-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - MD 190/River Road Sidewalk (CIP #506747).  A public hearing will be held at 4:00 p.m. on Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 101 Monroe St. in Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the north side of MD190/River Rd. from Rising Ridge Rd. to Seven Locks Rd. located in Bethesda, Maryland.  Being proposed is a concrete sidewalk on the north side of MD109/River Rd. from Rising Ridge Rd. to Seven Locks Road .  The sidewalk will be five feet wide and will conform to ADA requirements.  The total length of the sidewalk is 850 linear feet.  MD109/River Rd. is classified as a major roadway and has a variable width public right-of-way.  There is approximately 70' of available public right-of-way on the north side of River Rd.  If approved as listed by the County, expenditures authorized by this order plus expenditures accrued to date for this project shall not exceed $32,725.00 and shall be made payable from funds appropriatedfor CIP Project No. 506747.  Effective Date:  12/06/04.

MCEO 272-04: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - US 29/Colesville Road Sidewalk (CIP 506747). A public hearing will be held at 4:30 p.m. on Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 101 Monroe St. in Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the west side of US 29/Colesville Rd. from St. Andrews Way to 9316 Colesville Rd. located in Silver Spring, Maryland. A concrete sidewalk would be built on the west side of US 29/Colesville Rd. The sidewalk will be five feet wide and will conform to the ADA requirements with a total length of 615 feet. Seven adjacent property owners have been notified of this hearing. Effective Date: 12/06/04 .

MCEO 273-04: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Silent Valley Ln. - Dufief Dr. Sidewalk (CIP 506747). A public hearing will be held at 3:00 p.m. on Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 1101 Monroe St. in Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the (a) north side of Silent Valley Ln. from Happy Choice Ln. to 11605 Silent Valley Ln. and (b) both sides of Dufief Dr. from Darnestown Rd. to 400' south, located in Gaithersburg, Maryland. A concrete sidewalk scheduled to be built will be 4 feet wide and will conform to the ADA requirements. The total length of the sidewalks is 1100 linear feet. Silent Valley Ln. is classified as a secondary residential roadway with a 60 foot public right of way and on street parking is allowed on both sides. Dufief Dr. is classified as a primary residential roadway with a 70 foot public right of way. The existing roadway is approximately 24 feet wide and has on street parking on both sides. Ten adjacent property owners have been notified of this public hearing. Effective Date: 12/06/04.

MCEO 274-04:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Hampden Lane Sidewalk (CIP #506747).  A public hearing will be held at 3:30 p.m. Thursday, January 20, 2005, in the Lobby Level Auditorium of the Executive Office Building located at 101 Monroe St. in Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the north side of Hampden Ln. from Exeter Rd. to 5211 Hampden Ln. located in Bethesda, Maryland.  A concrete sidewalk will be built  under the Capital Improvement Project 506747 (Annual Sidewalk Program).The sidewalk will be 4 feet wide, will conform to the ADA requirements and the total length of the sidewalk is 350 linear feet.  Hampden Ln. is classified as a secondary residential roadway and has a 50 foot public right-of-way. Seven property owners have been notified of the public hearing.  Effective Date:  12/06/04.
