MCEO 49-05:  DEPARTMENT OF TECHNOLOGY SERVICES/OFFICE OF CABLE AND COMMUNICATION SERVICES  - CATV Rate Regulation - FCC 1235.  This Executive Order sets cable television rates for the add-on to the basic service pursuant to FCC form 1235 filed April 1, 2004.  Effective Date:  3/01/05.

 

MCEO 51-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Gaithersburg.  Install No Parking Any Time on Filbert Court around the traffic island in the center of the cul-de-sac.  Effective Date:  1/17/05. 

 

MCEO 52-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Gaithersburg.  Remove:  No Standing Any Time on Cabana Dr. around the traffic island in center of cul-de-sac, No Parking Any Time on Bloomingville Ct. around traffic island in center of cul-de-sac, on north end of  Valley Bend Dr. around traffic island in center of the island, on the south end of  Valley Bend Dr. around traffic island in center of cul-de-sac; install No Parking Fire Lane on Cabana Dr. around the traffic island in center of cul-de-sac, on Bloomingville Ct. around traffic island in the center of cul-de-sac, on north end of Valley Bend Dr. around traffic island in center of cul-de-sac, on south end of Valley Bend Dr. around the island in center of the cul-de-sac.  Effective Date:  1/23/05. 

 

MCEO 53-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic - Rockville.  Install No Parking Any Time on Catalpa Ct. around island in center of the cul-de-sac.  Effective Date:  2/23/05.

 

MCEO 55-05:  DEPARTMENT OF LIQUOR CONTROL - Amendment to FY05 Working Capital Requirement.  State law provides for the Director of Finance and the Director of the Department of Liquor Control (DLC) with the approval of the County Executive, to determine the amount of working capital required by the department and to retain from the Department's net profits the funds necessary to service DLC related debt and provide adequate working capital for the operation of DLC.  Because of the state law, both the County Attorney and the Attorney General have advised that the determination of the amount of funds required for these purposes is within the exclusive province of the County Executive, and is not subject to the County budget process.   It is therefore ordered that the working capital amounts are revised to read:  total working capital, $34,540,193 with $34,222,193 in the Operating Sub Fund and $318,000 in the construction sub-fund.  Effective Date:  2/25/05.

 

MCEO 56-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  According to Section 31-2, Montgomery County Code, 1994, as amended, DPWT is hereby directed to erect and/or remove the following traffic control devices establishing those streets or parts of streets described in the schedule as through streets, thereby granting right-of-way to traffic on said streets or parts of streets at all intersecting streets.  Street:  Dale Drive, From:   Wayne Avenue, to and
through:  Columbia Boulevard/Corwin Drive.  Effective Date:  2/28/05.

 

MCEO 57-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Rockville.  Remove No Parking Any Time on south side of Halpine Rd. from 120' west of Twinbrook Pkwy. to Twinbrook Pkwy.; install Metered Parking 7-AM - 7 PM Monday - Friday on south side of Halpine Rd from the City of Rockville limits (95' west of Pier Dr.) to 250' east of the City of Rockville limits, No Parking Any Time on south side of Halpine Rd. from 250' east of  the City of Rockville limits.  Effective Date:  2/28/05.

 

MCEO 58-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  Install No Parking Any Time around the entire turnaround on Brookmead Dr.  Effective Date:  2/27/05.

 

MCEO 59-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  Install No Parking Any Time on southeast side of Bryant's Nursery Rd. from Norwood Rd. to 510' northeast of Norwood Rd., on northwest side of Bryant's Nursery Rd. from 520' northeast of Norwood Rd. to Norwood Rd.  Effective Date:  2/27/05.

MCEO 61-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  Install:  Stop on northbound Diller Ln. at West Old Baltimore Rd., on southbound Diller Ln. at Deoudes Rd.  Effective Date:  2/27/05.

 

MCEO 62-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Brink Road Bridge - CIP 500503.  A public hearing will be held before the County Executive's designee at 3:00 p.m. on Thursday, April 21, 2005, in the first floor auditorium of the Executive Office Building at 101 Monroe Street in Rockville, Maryland to consider a proposal to replace the Brink Rd. Bridge, No. M-063 over Goshen Branch Tributary, a public highway bridge in Gaithersburg, Maryland   The plan is also to re-construct approximately 850' of approach roadways to tie the new structure into the existing roadway on both sides.  The total estimated cost of the project, including construction management and inspections, land acquisition, utilities, site improvements and construction is $1,069,000.00.  Effective Date:  3//04/05.

 

MCEO 63-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Michael Harrison, Fairland
Road Improvement - CIP Project No. 500402.  The option contract between Michael Harrison and Montgomery County Maryland for the purchase of land and granting of easements for the Fairland Road Improvement  project is hereby accepted.  The county attorney is therefore directed to take all necessary steps to acquire the land and easements.  Effective Date:  3/04/05.

MCEO 64-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Darrell A. Butler and Jacqueline N. Howell-Butler, Fairland Rd. Improvement Project CIP No. 500402.  The option contract between Darrell Butler and Jacqueline N. Howell-Butler and Montgomery County Maryland for granting of easement for the Fairland Road Improvement Project is herby accepted.  The county attorney is therefore directed to take all necessary steps to acquire the easement.  Effective Date:   3/04/05.

 

MCEO 65-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Renato Correa Dasilva, Fairland Rd. Improvement Project, CIP 500402.  The option contract between Renato Correa Dasilva and Montgomery County Maryland for the granting of easement for the Fairland Road Improvement Project has been accepted.  The county attorney is therefore directed to take all necessary steps to acquire the easement.  Effective Date:  3//04/05.

 

MCEO 66-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Cindy Theresa Douglas, Fairland Road Improvement Project - CIP Project No. 500402.  The option contract between Cindy Theresa Douglas and Montgomery County for the granting of easement for the Fairland Road Improvement Project has been accepted.  The county attorney is therefore directed to take all necessary steps to acquire the easement. Effective Date:  3/04/05. 

 

MCEO 67-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Lisa W. Conlon and John F. Conlon, Fairland Road Improvement Project - CIP Project No. 50040 the option contract between Lisa W. Conlon and John F. Conlon and Montgomery County for the granting of easement for the Fairland Road Improvement Project has been accepted.  Effective Date:  3/04/05.

 

MCEO 70-05:  OFFICES OF THE CONTY EXECUTIVE - Access to Performances at County Facilities.  Montgomery County Government leases certain county owned facilities to non-profit providers of the arts including the Music Center at Strathmore, the American Film Institute (AFI)/Silver Theatre and the BlackRock Center for the Arts.  As part of the agreements with these non-profit providers,
the county has as a property right, the use of a limited amount of admission tickets.  The Department of Recreation has responsibility for distribution of tickets for the BlackRock Center for the Arts and the AFI/Silver Theatre.  Distribution of tickets for the Music Center at Strathmore in the first year of operation will be handled through the Offices of the County Executive.  Effective Date:  3/10/05.

 

MCEO 71-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  According to Section 31-2, Montgomery County Code, 1994, as amended, DPWT is hereby directed to erect and/or remove the following traffic control devices establishing those streets or parts of street described in the schedule as through streets, thereby granting right-of-way to traffic on said streets or parts of streets at all intersecting streets.  Street:  Franklin Avenue, from Colesville Rd., to University Blvd.  Effective Date:  2/28/05. 

 

MCEO 72-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Bethesda.  Remove No Parking 9 AM - 6 PM, Monday - Friday on west side of Cortland Rd. from Western Ave. to Westport Rd.; install Permit Parking Only 9 AM - 6 PM, Monday - Friday on west side of Cortland Rd. from Andover Rd. to Western Ave.  Effective Date:  3/07/05. 

 

MCEO 73-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Pursuant to Section 31-2 and 31-10, Montgomery County Code, 1994 as amended DPWT is hereby directed to install and/or remove the following traffic and/or parking control devices at the designated location.  No Left Turn, No Through Movement on Randolph Village Exit Driveway at Randolph Rd.  Effective Date:  1/23/05.

 

MCEO 74-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - A public hearing was held on Wednesday, March 16, 2005, at 10:30 a.m. at 101 Monroe Street, EOB Auditorium, Rockville, Maryland  20850, to consider an application received from Macris, Hendricks and Glascock on behalf of Arthur Williams, seeking abandonment of a portion of unimproved Somerset Ln. adjoining property owned by the applicant in Colesville.  After the hearing, the hearing officer will report his findings and recommendations to the county executive for further consideration as prescribed by the County Code.  Effective Date:  3/14/05.

 

MCEO 75-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of option contract with Calverton Baptist c/o Haskell Todd, Trustee, Fairland Road Improvement - CIP Project No. 500402.  The option contract between Calverton Baptist Church, c/o Haskell Todd, Trustee, and Montgomery County for the purchase of land and granting the easements for the Fairland Road Improvement project has been accepted.  The county attorney is directed to take all necessary steps to acquire the easement.  Effective Date:  3/14/05.

 

MCEO 76-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Lawrence Blum and Barbara Blum, Muncaster Rd. Improvement, CIP Project No.509943.  The option contract between Lawrence Blum and Barbara Blum and Montgomery County Maryland for the granting of an easement for the Muncaster Rd. Improvement is accepted.  The county attorney is directed to take all necessary steps to acquire the easement.  Effective Date:   3/14/05.

 

MCEO 77-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Sebastian Ziraba and Ola M. Bell-Ziraba, Muncaster Road - CIP Project No. 509943.  The option contract between Sebastian Ziraba and Ola M. Bell Ziraba and Montgomery County Maryland for granting of easements for the Muncaster Rd. project is accepted.  The county attorney is therefore directed to take all necessary steps to acquire the easement. Effective Date:  3/14/05.

 

MCEO 78-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with John Wayerski, Liberty Mill Road Sidewalk - CIP Project No. 509036.  The option contract between John Wayerski and Montgomery for the granting of an easement for the Liberty Mill Rd. Sidewalk is accepted.  The county attorney is hereby directed to take all necessary steps to acquire the easement.  Effective Date:  3/14/05.

 

MCEO 79-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Alex K. Kamau, Sophia W. Kamau, Fairland Road Improvement - CIP Project No. 500402.  The option contract between Alex K. Kamau and Sophia W. Kamau and Montgomery County Maryland for the granting of easement for the Fairland Road Improvement Project  has been accepted.  The county attorney is hereby directed to take all necessary steps to acquire the easement.  Effective Date:  3/14/05.

 

MCEO  80-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  Install Stop on southbound Sweetleaf Lane at Goshen School Rd., on southbound Sweetleaf Rd. at Harrisons Farm Way.  Effective Date:  3/15/05.

 

MCEO  81-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  Install No Parking Any Time on perimeter of the island in cul-de-sac on Tech Rd. southwest of Industrial Dr., on northwest side of Tech Rd. from 100' northeast of the cul-de-sac southwest of US 29 and on all sides of the perimeter of the cul-de-sac to 100' northeast of the cul-de-sac southwest of US 29.  Effective Date:  3/08/05.

 

MCEO  82-05:  DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS - Designation of Nonprofit Organizations to Purchase or Rent MPDUs.  The county executive designates housing development agencies and nonprofit corporations which may purchase or lease Moderately Priced Dwelling Units (MPDUs) under Section 25-A 8(b) of the Montgomery County Code, 1994, as amended.  These organizations have demonstrated the ability to operate and maintain affordable housing satisfactorily and are eligible for participation in the MPDU program for the rental or purchase of MPDUs:  Mater Dei School, 9600 Seven Locks Road, Bethesda, MD; Stepping Stones Shelter, Rockville, MD; Community Support Services, Gaithersburg, MD; Guide Program Inc., Hyattsville, MD; Silver Spring Interfaith Housing Coalition, Silver Spring, MD.  Effective Date:  3/22/05.
