MCEO 269-04:  FIRE AND RESCUE SERVICE - Fire Lane Establishment.  A fire lane has been established at Seneca Park North Subdivision, 11100 Blk., Little Fox Terrace, 11100 Blk, Maryland Manor Ct.  DPWT is ordered to post fire lane signs and paint curbs/pavement (painting optional) at this location.  Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign.  Signs may be no farther apart than 100 feet.  When signs and paint work have been completed, this order authorizes the enforcement of this fire lane by appropriate police and fire officials.  The fine for parking in a fire lane is $250.00.  Effective Date:  12/07/04.

MCEO 17-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Malthaus A. Blake, Trustee to the Malthaus Avery Blake Living Trust, Fairland Rd. Improvement - CIP Project No. 500402.  The option contract between Malthaus A. Blake, Trustee to the Malthaus Avery Blake Living Trust and Montgomery County Maryland for the purchase of land and granting of easement for the Fairland Road Improve-ment has been accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land and easement.  Effective Date:  1/26/05.

 

MCEO 18-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  Install Stop on northwest bound Haverhill Dr. at Littledale Rd., Yield on northbound Haverhill Dr. spur at Littledale Rd., on southbound Haverhill Dr. spur of Littledale Rd. at Haverhill Dr.  Effective Date:  1/17/05.

MCEO 22-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Quince Orchard Road Improvements.  This is notice of a Public Hearing to be held at 3:00 p.m. on Thursday, March 3, 2005, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland  20850 to consider a proposal to provide safety spot improvements along Quince Orchard Rd., in the Gaithersburg Vicinity.  The improvements to be discussed are as follows:  modification to the existing medians and alignment of the entrance to Quince Orchard High School, improvements to the vertical curve near the intersection of Wonder View Way and Quince Orchard Rd., spot safety improvement to the horizontal curve at Damson Dr., construction of an eight-foot wide bikeway along the entire west side of Quince Orchard  Rd. from Darnestown Rd. to 600 feet south of BroughhamWay/Horse Center Rd, construction of missing links of sidewalk along the eastside of roadway from Darnestown Rd. to Quince Mill Drive.  Advance notice of the hearing was sent to 15 homeowners with adjoining properties.  Effective Date:  2/02/05.

 

MCEO 23-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - U.S. 29 Sidewalk (CIP 509997).  This is notice of a Public Hearing to be held at 3:00 p.m. on Wednesday, March 16, 2005, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland  20850 to consider a proposal to construct a sidewalk along the east side of U.S. 29 between Lorain Ave. and the bridge over Northwest Branch in the Four  Corners Area.  The improvements to be discussed are as follows:  construct three retaining walls - 1240', construct approximately 2700  linear feet of concrete sidewalk at the back of the existing curb, six feet in width at the retaining walls and five feet in width where there are no walls.  Data and files are available for examination in the offices of the Department of Public Works and Transportation, 101 Monroe St, Rockville, Maryland.  Effective Date:  2/02/05. 

 

MCEO 24-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Nicholson Lane Bridge (CIP 500504).  This is notice of a Public Hearing to be held at 3:00 p.m. on Monday, March 7, 2005, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland  20850, to consider a proposal to replace and widen the Nicholson Lane Bridge No. M-113 over CSX Railroad, a public highway bridge located in Rockville Maryland.  The improvements to be discussed are as follows:  replace the existing deteriorating Nicholson Lane Bridge over CSX Railroad and reconstruct approximately 65 feet of approach roadway to tie the new structure into the existing roadway on both sides, widen the new bridge to accommodate the future implementation of the local Master Plan that calls for an on-road bike path in each direction.  Project related data and files are available for examination in the offices of the Department of Public Works and Transportation at 101 Monroe Street, Rockville, Maryland.  Effective Date:  2/02/05.

MCEO 26-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Bethesda.  Install Stop for westbound traffic on Nelson Rd. at Montgomery Dr.  Effective Date:  1/26/05.

 

MCEO 27-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  Rescind all parking regulations from traffic order 31-90 on both sides of Prosperity Dr./Old Columbia Pike between Cherry Hill Rd. and Tech La.; install No Parking Any Time on both sides of Prosperity Dr. from Tech Rd. to 450' northeast of the entrance/exit driveway for 12401 Prosperity Dr., on both sides of Prosperity Dr. from 530' northeast of the entrance exit driveway for 12401 Prosperity Dr. to Cherry Hill Rd., No Parking 7 PM - 6 AM Monday - Friday on both sides of Prosperity Dr. from 50' northeast of the entrance/exit for 12401 Prosperity Dr. to 530 northeast of the entrance/exit for the same.  Effective Date:  2/03/05.

 

MCEO 28-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Maryland Avenue (CIP 506747).  This is notice of a public hearing to be held at 5:00 p.m. on Thursday, March 31, 2005, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland  20850, to consider a proposal to provide safe pedestrian travel along the east side of Maryland Ave. from Jones Bridge Rd. to South Chelsea La. located in Bethesda, Maryland.  The improvements to be discussed are as follows:  an 1100' sidewalk on east side of Maryland Ave. from Jones Bridge Rd. to South Chelsea La.  which will be four feet wide and will conform to ADA requirements.  Maryland Ave. is classified as a secondary residential roadway, has a 50' public right-of-way and is approximately 22' wide.  On street parking is allowed on both sides and there is approximately 14' of available public right-of-way on east side of Maryland Ave.  The sidewalk will be constructed with a zero foot greenspace and constructed to cause minimal disturbance within the public right-of-way.   Effective Date:  2/08/05.

 

MCEO 29-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Fernwood Road/Brixton Lane (CIP 506747).  This is notice of a public hearing to be held at 3:00 p.m. on Thursday, March 31, 2005, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland  20850, to consider a proposal to construct a sidewalk along the east side of Fernwood  Rd. from Stoneham Rd. to 9715 Fernwood Rd. and both sides of Brixton La. from Fernwood Rd. to the existing sidewalks ending at 9717 and 9710 Brixton La. located in Bethesda, Maryland.  The improvement to be discussed is as follows:  a concrete sidewalk on the east side of Fernwood Rd. from Stoneham Rd. to 9715 Fernwood Rd. and on both sides of Brixton La. located in Bethesda.  Fernwood Rd. is classified as a primary residential roadway with a 70' public right-of-way.  The roadway is approximately 24' wide with approximately 23' of available public right-of -way on the east side and the sidewalk will be constructed with an approximately four foot greenspace between the sidewalk and existing edge of roadway.  Brixton La. is classified as a secondary residential roadway with a 60' public right-of-way and is approximately 26' wide with onstreet parking allowed on both sides.  The sidewalk will be constructed with an 11' greenspace between the sidewalk and existing curb and gutter, and the sidewalk will be constructed with an approximately 11' greenspace between the sidewalk and the existing curb and gutter.  Every effort will be made to cause minimal  disturbance within the public right-of-way.  Effective Date:  2/08/05.

 

MCEO 30-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - MD 190/River Road (CIP 506747).  This is notice of a public hearing to be held at 4:30 p.m. on Thursday, March 31, 2005, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland  20850 to consider a proposal to provide safe pedestrian travel along the north side of MD190/River Road from Falls Road to 10219 River Road located in Potomac, Maryland.  Proposed is a 5 foot wide concrete sidewalk conforming to ADA requirements on the north side of MD190/River Road from Falls Road to 10219 River Road.  River Road is classified as a major roadway and is approximately 50 feet wide with a variable width of public right-of-way thus requiring a purchase of right-of-way along the two properties.  The sidewalk will be constructed with a variable greenspace of zero to three feet in width between the sidewalk and curb.  Project related data and files are available for examination in the offices of  DPWT on the 11th floor of the Executive Office Building.  Effective Date:  2/08/05. 

 

MCEO 31-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Bonifant Street (CIP 506747).  This is notice of a public hearing to be held at 4:00 p.m. on Thursday, March 31, 2005, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland  20850 to consider a proposal to provide safe pedestrian travel along the north side of Bonifant St. from Dale Dr. to Cedar St. located in Silver Spring, Maryland.  Proposed is a 4 foot wide concrete sidewalk which conforms to ADA requirements on the north side of Bonifant St. from Dale Dr. to Cedar St.  The total length of the sidewalk will be 975 linear feet.  Bonifant St. is classified as a secondary residential roadway with a 50  foot public right-of-way and the roadway is approximately 22 feet wide.  There is approximately 14 feet of available public  right-of-way on the north side of Bonifant St.  The sidewalk will be constructed at the back of the existing curb and gutter.  An effort will be made during construction to cause minimal disturbance in the public right-of-way.  Project related data and files are available for examination in the offices of the Department of Public Works and Transportation on the 11th floor of the EOB.  Effective Date:  2/08/05.

 

MCEO 32-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Exeter Road (CIP 506747).  This is notice of a public hearing to be held at 3:30 p.m. on Thursday, March 31, 2005, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland  20850 to consider a proposal to provide safe pedestrian travel along the  east side of Exeter Rd. from 9609 Exeter Rd. to Moorland La. located in Bethesda, Maryland.  Proposed is a 300 linear foot, four foot wide sidewalk which conforms to ADA requirements.  Exeter Road is classified as a secondary residential roadway with a 50' public right of way and the existing roadway is approximately 22 feet wide.  There are approximately 14 feet of available public right-of-way on the east side of Exeter Rd. and the sidewalk will be constructed with a variable greenspace of approximately 4-9 feet in width between the sidewalk and the existing wedge of roadway.  Project related data and files are available for examination in the
offices of the Department of Public Works and ransportation on the 11th floor of the EOB.  Effective Date:  2/08/05.

 

MCEO 33-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order.  Remove:  No Thru Trucks or Buses Over 7,000 pounds GVW on Grove St. between Bonifant St. and Sligo Ave.; install No Thru Vehicles Over 7,000 Pounds GVW.    Effective Date:  1/23/05. 

 

MCEO 34-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  Remove No Parking Any Time on the southwest side of Crystal Rock Dr. from 85' north of Shadyside La. to Father Hurley Blvd., from 185' north of Shadyside La. to Father Hurley Blvd.   Effective Date:  2//08/05.

 

MCEO 35-05:  DEPARTMENT OF - PUBLIC WORKS AND TRANSPORTATION  -  Persimmon Tree Road Sidewalk (CIP 506747).   The county executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Potomac, Maryland.  The 5500 linear feet sidewalk will be eight feet wide and will conform to the ADA requirements.  Persimmon Tree Road is approximately 20 feet wide, classified as an arterial roadway, and has a variable width public right-of-way.  Approximately 20 feet of public right-of-way space is available on the west side of Persimmon Tree Road.  The greenspace between the sidewalk and edge of roadway will vary from 4 to 10 feet.  A public hearing was held on the project on October 6, 2004 and the hearing examiner recommended approval of the project.  The total cost of the project, to be determined by final accounting after construction has been completed, is estimated at $186,640.000.  Effective Date:  2/18/05.

 

MCEO 36-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Hampden Lane Sidewalk (CIP 506747).  The county executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Bethesda, Maryland.  The 340 linear foot sidewalk will be four feet wide and will conform to ADA requirements.  Hampden Lane is classified as a closed section secondary residential roadway and has a 20 foot wide roadway with a 50 foot public right-of-way.  On street parking is allowed on the south side of the roadway.  There are approximately 15 feet of available public right-of-way on the north side of Hampden Lane.  The greenspace between the sidewalk and curb will vary from 0 to 6 feet.  The variance in the width of greenspace is necessary to avoid the removal or relocation of various obstacles encountered within the public right-of-way such as trees and telephone poles.  A public hearing was held on October 6, 2004 and the hearing examiner recommended approval of the project.  The total cost after construction is estimated at $14,850.  Effective Date:  2/18/05.

 

MCEO 37-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Liberty Mill Road (CIP 509036).  The county executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Germantown, Maryland.  The 1,000 linear foot sidewalk will be 4 feet wide and will conform to the ADA requirements.  Liberty Mill Road is classified as a secondary residential roadway and has a 22 foot roadway with a variable width public right-of-way.  There are approximately 5 feet of available public right-of-way on the west side of Liberty Mill Road and the greenspace will vary from 0 to 3 feet.  A public hearing was held on the project on October 6, 2004, and the hearing officer recommended approval of the project.  The total estimated cost of the project after construction is $38,500.00.  Effective Date:  2/18/05. 

 

MCEO 38-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Stedwick Road (CIP 509036).  The county executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Gaithersburg, Maryland.  The 900 linear foot, five foot wide concrete sidewalk will be constructed on the north side of  Stedwick Road from Watkins Mill Road to the existing sidewalk located approximately 900 feet west of Watkins Mill Road.  Stedwick Road is classified as a primary residential roadway and has a 36 foot wide roadway with a 70 foot public right-of-way.  A public hearing was held on the project on October 6, 2004, and the hearing examiner recommended approval of the project.  The total estimated cost of the project after construction is 29,700.00.  Effective Date:  2/18/05.

 

MCEO 39-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Walden Road Sidewalk (CIP 509036).  The county executive finds that public interest requires construction of a sidewalk in the public right-of-way located in Silver Spring, Maryland.  A 445 linear foot, 4 feet wide concrete sidewalk which will conform to the ADA requirements, will be built on the east side of Walden road  from 9015 Walden Rd. to Wayne Ave.  Walden Rd. is classified as a secondary residential roadway and has a 50 foot public right-of-way with a 26 foot wide roadway.  On street parking is allowed on both sides of the roadway.  There are approximately 12 feet of available public right-of-way on the east side of Walden Rd. and the greenspace between the sidewalk and curb will vary from 3 to 7 feet.  A public hearing was held on the project on October 6, 2004, and the hearing examiner recommended approval of the project.  The total estimated cost once the construction is finished is $15,070.00.  Effective Date:  2/18/05.

 

MCEO 40-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Silver Spring.  Remove No Parking Any Time on north side of Elton Rd. from 1115' east of New Hampshire Ave. to 1010' east of same; install No Parking Any Time on north side of Elton Rd. from 35' east of the entrance/exit at 1730 Elton Rd. to 40' west of the entrance/exit at 1730 Elton Rd., No Parking 8 PM - 6 AM Monday - Friday on the north side of Elton Rd. from 40' west of the entrance/exit at same.  Effective Date:  2/08/05.

Rochelin and Montgomery County Maryland for the purchase of land and granting of easements for the Fairland Road Improvements project is hereby accepted.  The county attorney is hereby directed to take all necessary steps to acquire the land and easement.  Effective Date:  2/18/05. 

 

MCEO 44-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with Pierre R. Guirand and Tanie A. Guirand Manor Park Dr. Storm Project.  The option contract between Pierre R. Guirand and Tanie A. Guirand and Montgomery County Maryland for granting of easements for the project is hereby accepted.  The county attorney is hereby directed to take all necessary steps to acquire the easements.  Effective Date:  2/18/05. 

 

MCEO 45-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with James P. Kuhn and Linda S. Kuhn, Fairland Road Improvement CIP Project No. 500402.  The option contract between James P. Kuhn and Linda S. Kuhn and Montgomery County Maryland for the purchase of land and granting of easements for the project is hereby accepted.  The county attorney is hereby directed to take all necessary steps to acquire the lad and easements.  Effective Date:  2/18/05.

 

MCEO 46-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Acceptance of Option Contract with the  Estate of Priscilla Mary Auvil, Muncaster Road Improvement, CIP Project No. 500943.  The option contract between the Estate of Priscilla Mary Auvil c/o Jo Anne Morris, Personal Representative and Montgomery County Maryland for the purchase of land and granting of easements for the project is hereby accepted.  Effective Date:  2/18/05. 

 

MCEO 47-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Condemnation Authorization - Chancellor Media Corporation of the Capital City, Brookville Service Park CIP No. 509928.  Since plans for the Brookville Service Park state that the property owned by Chancellor Media Corporation of the Capital City, dba Clear Channel AM Washington and an easement interest in adjoining property are needed for the above project, and Montgomery County and the owner of said property have been unable to agree upon a sum to be paid for the property, the county may institute condemnation proceeding under Section 49-46 of the Montgomery County Code 1994.  The county attorney is directed to acquire by condemnation the following property which is needed by the county for the Brookville Service Park project.   Effective Date:  2/18/05. 

 

MCEO 48-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Wheaton/Glenmont.  Remove (T.O. 18-80) Yield on Kilt Terrace so as to yield westbound traffic at Briars Rd., on Thornhurst Dr. so as to yield eastbound traffic at Briars Rd.; install Stop for westbound traffic on Kilt Ter. at Briars Rd., for eastbound traffic on Thornhurst Dr. at Briars Rd.  Effective Date:  2/03/05. 

 

MCEO 50-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of an Alley, Block D South Silver Spring, Maryland.  A public hearing was held at 3:30 p.m. on Wednesday, February 23, 2005, at 101 Monroe Street in the Lobby Level Auditorium, Rockville, Maryland  20850, to consider an application received from Holland & Knight on behalf of RST Development seeking abandonment of an alley within Block D bounded by Eastern Ave. on the west, 13th Street on the north, Georgia Ave. on the east, and King St. on the south in South Silver Spring.  The application is associated with a mixed use development proposal to include approximately 325 residential units and a structured parking garage to replace County Parking Lot 16.  After the hearing, the hearing officer will report his findings and recommendations to the County Executive for further consideration as prescribed the County Code.  Effective Date:  2/18/05.

 

MCEO 54-05:  DEPARTMENT OF PERMITTING SERVICES - Street Acceptance.  This certifies that construction of the following named streets has been completed in accordance with all applicable provisions of the Montgomery County Road Construction Code as specified in the permit.  The materials used in the construction of these streets were tested and found to be in compliance with county specifications:  Black Stallion Court, Black Stallion Way, Richter Farm Rd., Sanderling Pl, (Clopper Mill West), Thistlebridge Dr., Thistlebridge Way Arbor Crest Way (Small's Nursery), Brown Farm Ct., Brown Farm Way, Sapling Ridge La, (Denit Estates), Broken Oak Rd. (Seneca View Estates), Morningside Dr. (Jacksons Acres), Manor Spring Ter., (Manor Spring West), Unicorn Way (Willow Oaks), Natia Manor Dr., Ramsburg Ct. (Natalie Estates.  Effective Date:  2/23/05.
