MCEO NO. 34-06: FIRE AND RESCUE SERVICE - Fire Lane Establishment. This order is notification of the establishment of a fire lane at the French International School, 9600 Forest Road. The department is hereby ordered to post fire lane signs and paint curbs/pavement (painting optional) in the location listed above. When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials. Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign. The fine for parking in a fire lane is $250.00. Effective Date: 2/28/06.

MCEO NO. 42-06: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Bethesda Bikeways (CIP 500119). The County Executive finds that it is in the public interest to provide bikeway and pedestrian improvements along locations in Bethesda, Maryland. Some of the improvements will be at the intersection of Bethesda Ave. and Woodmont Ave. and will include expanding the existing pedestrian refuge island, a 510 square foot area bump-out on northwest corner of Bethesda Ave./Woodmont Ave.; expansion of crosswalks to 16' wide; expansion of handicap ramps to 6' wide landings; modifications to existing traffic signal to accommodate the new crossing distances. Improvements to Norfolk Ave. between Rugby/Glenbrook Avenues to Woodmont Ave. will include intersection bump-outs at the following intersecting streets with Woodmont Ave: Rugby Ave./Glenbrook Ave; Auburn Ave; Del Ray Ave; Cordell Ave; St. Elmo Ave.; Fairmont Ave.; and will modify the existing traffic signals with provisions for Pedestrian Countdown Timers. A public hearing was held on the project on Thursday, October 27, 2005, in the lobby level auditorium of the Executive Office Building and the hearing examiner recommended approval of the project. The total estimated cost of the project will be $768,373.00. Effective Date: 2/16/06.
MCEO NO. 43-06: OFFICE OF THE COUNTY ATTORNEY - Non-Local Park Acquisition. The County Executive has determined that acquisition of the Rickman Horse Farm is necessary as parkland. This was decided after a public hearing held on January 26, 2006, and it was approved for acquisition in the "FY 06 Capital Budget." Therefore the County Attorney is directed to acquire by purchase or condemnation the Rickman Horse Farm. Effective Date: 2/23/06.
MCEO NO. 44-06: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Abandonment of 10-foot Path, Hendry Estates Subdivision, Bethesda. There was a public hearing held at 10:30 AM on March 2, 2006, at 101 Monroe Street, EOB, 10th Floor Large Conference Room, Rockville, Maryland, 20850, to consider an application received from Bulman Dunie, Burke & Feld on behalf of its clients, John A. Moore III and Brianna M. Moore, seeking abandonment of a portion of an unimproved 10-foot path adjoining their property, Hendry Estates subdivision in Bethesda. The hearing officer will report his findings and recommendations to the County Executive for further consideration as prescribed by County Code. Effective Date: 2/22/06.

The option contract between Joaquin Paez and Socorro de Paez and Montgomery County for the granting of an easement for the Park Lane Storm Drain project is accepted. MCEO NO. 48-06: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Faith Methodist Church of Montgomery County has executed an easement for the right of way to the Washington Suburban Sanitary Commission (WSSC) needed for WSSC to relocate a fire hydrant onto the Church's property, in conjunction with the construction of Montrose Parkway. Montgomery County is requiring the relocation of the facility and is agreeable to paying for the easement necessary for the relocation of the hydrant. Effective Date: 2/22/06.

A pubic hearing will be held at 3:00 pm on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe St., Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the west side of Neelsville Church Road from Church Bend Court to Scenery Drive located in Germantown, Maryland. A 4' wide concrete sidewalk is planned and will conform to the ADA requirements. The sidewalk will be 1170 linear feet long. Neelsville Church Rd. is a secondary residential roadway and has 80' of public right-of-way on the west side. The sidewalk will be constructed with a varying amount of greenspace. The estimated cost of the sidewalk is $60,500.00. Effective Date: 2/22/06.

A public hearing will be held at 3:30 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the south side of Hornbeam Dr. from Sycamore Ln. to the Flower Valley Park Entrance and west side of Sycamore Ln. from Hornbeam Dr. to Muncaster Mill Rd. located in Rockville, Maryland. A 4 foot wide concrete sidewalk is planned which will conform to the ADA requirements. The sidewalk will be 1300 linear feet long and Hornbeam Dr. classified as a secondary residential roadway, has 60' of public right-of-way. The present road is 20' wide with 20' of available public-right-of way along the south side. The total length of the sidewalk along Sycamore Ln. is 650'. It will be constructed with a varying amount of greenspace. The estimated cost of the sidewalk is $63,600.00. Effective Date: 2/22/06.
MCEO NO. 52-06: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Pearl Street Sidewalk (CIP #506747). A public hearing will be held at 4:30 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the west side of Pearl St. from Our Lady of Lourdes Catholic Church to Sleaford Dr. located in Bethesda. The 4 foot wide concrete sidewalk will conform to ADA requirements. The total length of the sidewalk is 625 linear feet. Pearl Street is classified as a secondary residential roadway and has a 50' public right-of-way. It is 23' wide with 15' of available public right-of-way along the west side of Pearl St. The sidewalk will be constructed at the edge of new concrete curb. Estimated cost for the project is $66,700.00. Effective Date 2/22/06.
MCEO NO. 53-06: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Newport Mill Road Sidewalk (CIP #506747). A public hearing will be held at 4:00 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the west side of Newport Mill Road from the existing sidewalk at 11604 Newport Mill Road to Veirs Mill Road, located in Wheaton, Maryland. A 4 foot wide concrete sidewalk is planned which will conform to the ADA requirements. The total length of the sidewalk is 190 linear feet. Newport Mill Road is classified as a primary residential roadway and has a 60' public right-of-way. The roadway is 30' wide with approximately 15' of available public right -of-way along the west side of Newport Mill Rd. The sidewalk will be constructed with varying greenspace. The estimated cost of the total proposed improvement is $27,700.00. Effective Date: 2/22/06.
MCEO NO. 54-06: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Nickelby Drive and Bloom Drive Sidewalk (CIP #506747). A public hearing will be held at 5:00 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the south side of Bloom Drive from Ridge Road to Nickelby Drive and the west side of Nickelby Drive from Bloom Drive to Cutsail Road located in Damascus. A 4 foot wide concrete sidewalk is planned and will conform to the ADA requirements. The total length of the sidewalk along Bloom Dr. is 495 linear feet and Bloom Dr. is classified as a business district roadway with a 60' public right-of-way. The roadway on Bloom Dr is 26' wide with approximately 17' of available public right-of-way along the south side of Boom Drive. The total length of the sidewalk along Nickelby Drive is 1600 linear feet. Nickelby Drive is classified as a secondary residential roadway and has a 60 foot public right-of-way. The road is 26' wide with approximately 17' of available public right-of-way along the west side of Nickelby Drive. The sidewalk will be constructed with varying greenspace. The total estimated cost of this project is $52,100.00. Effective Date: 2/22/06.
MCEO NO. 55-06: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Forest Glen Road Bikeway. A public hearing will be held at 5:30 PM on Wednesday, April 5, 2006, in the Lobby Level Auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland, to consider a proposal to provide safe pedestrian and bicycle travel along the south side of Forest Glen Road from Georgia Ave. to the Sligo Creek Trail, located in Silver Spring, Maryland. An asphalt bikeway is proposed to replace the existing concrete sidewalk. The bike path will vary from 6' to 8' in width and will conform to ADA requirements. The total length of the bike path along Forest Glen Rd. is 2,540 linear feet. Forest Glen Rd. is classified as an arterial roadway and has an 80 foot public right-of-way. The road is 24' wide and has approximately 30' of available public right-of-way on the south side of Forest Glen Road from Georgia Ave. to the Sligo Creek Train. The bikeway will be constructed with a varying greenspace. The total estimated cost of this project is $135,500.00. Effective Date: 2/22/06.

Montgomery County needs to acquire a real property interest from the Farm Development COOP, LLC property, in connection with the Department of Public Works and Transportation, Stringtown Rd. project, CIP Project No. 500403. The County and the owners of said property have been unable to agree upon a sum to be paid for the property, and Montgomery County may institute condemnation proceedings under Section 49-46 of the Montgomery County Code 2004. Therefore the County Attorney is directed to acquire by condemnation the property needed by the County for the Stringtown Road project. Effective Date: 3/06/06.

MCEO NO. 103-06: OFFICES OF THE COUNTY EXECUTIVE - Senior Citizen Fire Safety Task Force. Because studies have shown that senior citizens - presently the fastest growing population - are especially at risk from fire dangers, the Senior Citizen Fire Safety Task Force was established as an executive committee on March 24, 2006. This task force will advise the Executive and Fire Chief on procedures designed to reduce the risk of fire-related deaths and injuries to senior citizens in the County. The task force will consist of 25 members appointed by the Executive and representing persons of diverse social, cultural, and economic backgrounds, and ex-officio members from designated public agencies.
