MCEO NO. 351-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Fairfax Road Sidewalk (CIP 506747).  A public hearing was held at 6:00 PM on Thursday, January 26, 2006, in the lobby level auditorium of the Executive Office Building at 101 Monroe Street, Rockville, Maryland to consider a proposal to provide safe pedestrian travel along the west side of Fairfax Road from 6917 Fairfax Road to Clarendon Rd, located in Bethesda, Maryland.  A concrete sidewalk, 4' wide and 2000' long and conforming to the requirements of the ADA, will be built on the west side of Clarendon Rd. which is classified as a secondary residential roadway and has a 50' public right-of-way.  The existing roadway is 20' wide with 15' of available public right-of-way on west side of Fairfax Rd. from Hampden Lane to Wessling Lane and 15' of available public right-of-way on east side of Fairfax Rd. from 6917 Fairfax Road to Clarendon Rd.  The sidewalk will be constructed at the back of the curb and gutter.  The total estimated cost of the project is $179,530.23 and it will be paid for from funds from the CIP Project 506747.  Effective Date:  12/02/05.

 

MCEO NO. 352-05:  FIRE AND RESCUE SERVICE - Fire Lane Establishment.  This order is notification of the establishment of a fire lane at South Ridge Homeowners Association, Watershed Ct., Kelso Ter., Tea Rose Dr.  The department is hereby ordered to post fire lane signs and paint curbs/pavement (painting optional) in the location listed above.  When signs and paint work have been completed, this order will authorize the enforcement of this fire lane by appropriate police and fire officials.  Signs must be posted so that it is not possible to park a vehicle without being in sight of a sign.  The fine for parking in a fire lane is $250.00.  Effective Date:  12/02/05.

 

MCEO NO. 353-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Montrose Parkway West - CIP 500311.  The option contract between Miryam S. Teitler and Montgomery County, Maryland, for the purchase of land for the Montrose Parkway West Project - CIP No. 500311 is accepted.  The County Attorney is directed to take all necessary steps to acquire the land.  Effective Date:  12/06/05.

 

The Department of Public Works and Transportation implemented a new database for tracking all traffic orders.  Many traffic devices/signs have been renumbered and listed as removed and installed again.  In actuality, these signs remain in place but are renumbered only in the new database.  They will be listed with new numbers in the areas in which they are located but not the specific locations.

MCEO NO. 356-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Muncaster Road Improvements, CIP Project No. 509943.  Montgomery County has acquired by "Advance Taking" the Granby Farm LLC, which is necessary for the construction of the Muncaster Road Improvements project.  Since the County and owners of the property have been unable to agree upon a sum to be paid for the property, and Montgomery County may institute condemnation proceedings under the Montgomery County Code 2004, as amended, the County Attorney is directed to acquire by condemnation the described property which is necessary for the project in connection with Capital Improvements Program Project No. 509943.  Effective Date:  12/14/06.

 

MCEO NO. 357-05:  DEPARTMENT OF LIQUOR CONTROL - State law provides that the Director of Finance and the Director of the Department of Liquor Control (DLC) with the approval of the County Executive, determine the amount of working capital required by the department, retain from the Department's net profits (before making any deposit into the General Fund of the County) the funds necessary to service DLC related debt and provide adequate working capital for the operation of DLC.  Because of the State law, the County Attorney and Attorney General have advised that the determination of the amount of funds required for these purposes is within the exclusive province of the County Executive, and is not subject to the County budget process.  The Director of the DLC requests increasing the Working Capital Fund by $250,000 to cover build-out and preparation costs to move the current liquor store in Chevy Chase to a new location in Chevy Chase.  The DLC total working capital amount will therefore be changed to $30,934,000 and the fund amounts are revised as follows:  Personnel Costs - $19,488,260, Operating Expense - $10,011,740, Capital Outlay - $1,423,000.  Effective Date:  12/22/05.

 

MCEO NO. 358-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Bethesda.  This order directs the department to erect and/or REMOVE the following traffic control devices establishing those streets or parts of street described in the schedule as through streets, thereby granting right-of-way to traffic on said streets or parts of street at all intersecting streets.  REMOVE Traffic Order 183-79 on Sangamore Rd from Massachusetts Ave. to Brookes Ln., on Sangamore Rd. from Brookes Ln. MCEO NO. 366-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Wheaton/Glenmont.  REMOVE No Parking School Days 7:30 AM - 4:00 PM on west side of Goodhill Rd. from 40' south of Janet Rd. to 35' north of Isbell St.  Effective Date:  12/27/05.

 

MCEO NO. 367-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Park Lane Storm Drain - CIP Project No 500508.  The option contract between Gregory Kiel and Montgomery County, Maryland, for the granting of an easement for the Park Lane Storm Drain is accepted.  The County Attorney is directed to take all the necessary steps to acquire an easement.  Effective Date:  12/27/05.

 

MCEO NO. 368-05:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Montrose Parkway West - CIP 500311.  The option contract between Ilias Papageorgopoulos and Montgomery County, Maryland for the purchase of land for the Montrose Parkway West project is hereby accepted.  The County Attorney is directed to take all necessary steps to acquire the land.  Effective Date:  12/29/05.

 

MCEO NO. 369-05:  OFFICE OF MANAGEMENT AND BUDGET - CIP Cost Criterion for Special Capital Improvements Projects FY 07.  Non-emergency County Government capital improvement projects estimated to cost at least four million dollars must be approved by a law enacted by the County Council, prior to receiving further appropriation, and the County Executive shall, by annual Executive Order, revise the four million dollar cost criterion for all major facilities to reflect the annual change in the latest published composite construction cost index established by the US Department of Commerce.  Since the construction cost index (1966=100) was 46.1 for June of 1978 and 149.0 for June of 2005, the amount of the increase to be added to the original $4,000,000 is $8,928,000 bringing the total FY 2007 cost criterion to $12,928,000 for the budget for the years 2007-2012 Capital Improvements Program.  Effective Date:  1/03/06.

MCEO NO. 2-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Montrose Parkway West - CIP No. 500311.  The option contract between Exec Plaza, LLC and Montgomery County, Maryland for the purchase of land for the Montrose Parkway West project is hereby accepted.  The County Attorney is hereby directed to take all necessary steps to acquire the land.  Effective Date:  1/06/06.

 

MCEO NO. 3-06:  OFFICE OF THE COUNTY ATTORNEY - Non Local Park Acquisition.  The County Executive has determined that acquisition of Uncle Tom's Cabin of the estate of Hildegarde Mallet-Prevost is necessary as parkland and such a determination was made after a public hearing on January 5, 2006.  It was approved for acquisition in the FY 06 Capital Budget and the County Attorney was directed to purchase the property.  Effective Date:  1/10/06.

 

MCEO NO. 4-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Montose Parkway West - CIP No. 500311.  The option contract between Vatchik Mardirossian, Deanne New and Montgomery County, Maryland, for the purchase of land for the Montrose Parkway West project was accepted.  The County Attorney is directed to take all necessary steps to acquire the land.  Effective Date:  1/12/06.

 

MCEO NO. 5-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Traffic Order - Germantown.  INSTALL No Parking Any Time on south side of Huntmaster Rd. from 5' east of the termination of the one-lane bridge to 90' east of the termination of the bridge.  Effective Date:  1/03/06.

 

MCEO NO. 6-06:  DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Sonoma/Arylawn Storm Drain (CIP #500509.  The County Executive finds that public interest requires a replacement storm drain system for the existing inadequate surface drainage ditches which run along the edge of the roads and on private properties in the Ayrlawn area and cause inundation of the roadway, sidewalks and private property.  The project will include improvements along Sonoma Rd. from Old Georgetown Rd. to Sonoma Ln., and along Seneca Ln, Grant St., and Mohawk Ln. from Greentree Rd. to their dead end terminus.  A public hearing was held on the project at 3:00 PM. on Tuesday, November 15, 2005, in the lobby level auditorium of the Executive Office Building at 101  Monroe St. in Rockville, Maryland  20850.  The hearing examiner recommended approval of the project.  The total estimated cost of the project is $2,525,000.00 for construction management and inspections, land acquisition utilities, site improvements and construction.  This shall be payable from funds for the CIP Project No. 500509.  Effective Date:  1/18/06.
