MCEO NO. 179-07: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Redland Road from Crabbs Branch Way to Needwood Road Improvements, CIP No. 500010. The option contract between Debra Crone and Michael Lasko and Montgomery County, Maryland, for the granting of an easement for the above-referenced project is hereby accepted. MCEO NO. 180-07: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Falls Chapel Way Sidewalk - CIP No. 506747. A public hearing was held at 3:00 PM on June 28, 2007, in the Lobby Level Auditorium of the Executive Office Building, 101 Monroe St., Rockville, Maryland, to consider a proposal to provide safe pedestrian travel on the west side of Falls Chapel Way from Cold Spring Rd. to Orchard Brook Dr. located in Rockville, Maryland. The sidewalk will be five' wide and will conform to the ADA requirements. The total length of the sidewalk is 3,200 linear feet. Falls Chapel Way is classified as a closed section primary residential roadway and has a 70' public right-of-way. The existing roadway is approximately 36' wide. On-street parking is allowed on both sides of the roadway. There is approximately 17' of available public right-of-way on the northwest side of Falls Chapel Way. The green space between the sidewalk and curb will be approximately 10 feet. Every effort will be made during construction to cause minimal disturbance within the public right-of-way. Estimated cost of the proposed improvement and estimated funding allocations are as follows: Construction costs - $86,000.00; administrative and construction inspection costs - $8,600.00; total estimated cost of the project, including engineering site improvements and construction - $94,600.00. A public hearing was held at 3:00 PM on Tuesday, April 17, 2007, in the Lobby Level Auditorium of the Executive Office Building, 101 Monroe St., Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the east side of 1st Ave. between Noyes Dr. and Ballard St. and to continue along the north side of Ballard St. from 1st Ave. to Georgia Ave., located in Silver Spring, Maryland. The sidewalk will be 5' wide and will conform to the ADA requirements. The total length of the sidewalk is approximately 1,100 linear feet. 1st Ave. has a 60' public right-of-way and the existing roadway is approximately 26' wide. Ballard St. has a 60' public right-of-way and the existing roadway is approximately 32' wide. There is approximately 1' of available public right-of-way on the east side of 1st Ave. and approximately 12' of available public right-of-way on the north side of Ballard St. The sidewalk will be constructed with a varying greenspace of zero to six feet. Every effort will be made during construction to cause minimal disturbance within the public right-of-way. Estimated cost of the proposed improvement and estimated funding allocations are as follows: Construction costs - $54,210.00; administrative and construction inspection costs - $5,420.00; total estimated cost of the project, including engineering, site improvements and construction - $59,630.00. A public hearing was held at 3:30 PM on Tuesday, April 17, 2007, in the Lobby Level Auditorium of the Executive Office Building, 101 Monroe St., Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the east side of Denton Road/Hampden Lane from 7405 Denton Road to 5109 Hampden Lane, located in Bethesda, Maryland. The sidewalk will be 4' wide and will conform to the ADA requirements. The total length of the sidewalk is approximately 300 linear feet. Denton Road and Hampden Lane are both classified as secondary residential roadways. Denton Road has a 50' public right-of-way and the existing roadway is approximately 22' wide. There is approximately 14' of available public right-of-way on the east side of Denton Road. Hampden Lane has a 50' public right-of-way and the existing roadway is approximately 20' wide. There is approximately 15' of available public right-of-way on the east side of Hampden Lane. The sidewalk will be constructed with a varying green space of zero to three feet. Every effort will be made during construction to cause minimal disturbance within the public right-of-way. Estimated cost of the proposed improvement and estimated funding allocations are as follows: Construction costs - $39,767.00; administrative and construction inspection costs - $3,976.00; total estimated cost of the project, including engineering, site improvements and construction - $43,743.00. A public hearing was held at 4:00 PM on Tuesday, April 17, 2007, in the Lobby Level Auditorium of the Executive Office Building, 101 Monroe St., Rockville, Maryland, to consider a proposal to provide safe pedestrian travel along the unimproved public right-of-way located on Auth Lane from Stonington Road to Hermleigh Road, located in Silver Spring, Maryland. The sidewalk will be 5' wide and will conform to the ADA requirements. The total length of the sidewalk is 510 linear feet. Auth Lane is classified as a secondary residential roadway and has approximately 60' of available public right-of-way along this unimproved portion of Auth Lane. Every effort will be made during construction to cause minimal disturbance within the public right-of-way. Estimated cost of the proposed improvement and estimated funding allocations are as follows: Construction costs - $35,000.00; administrative and construction inspection costs - $3,500.00; total estimated cost of the project, including engineering, site improvements and construction - $38,500.00. MCEO NO. 187-07: DEPARTMENT OF HEALTH AND HUMAN SERVICES - Employee/Volunteer Solicitation Waiver. Pursuant to the Montgomery County Public Ethics Law, the County Executive authorizes public employees and volunteers of the Montgomery County Department of Health and Human Services, Child Welfare Services, The Tree House Child Assessment Center of Montgomery County, Maryland to solicit gifts for the benefit of the programs and services administered by the Montgomery County Department of Health and Human Services in accordance with the requirements of established by this Executive Order. All gifts must be publicly acknowledged unless the donor requests in writing that no public acknowledgment is to be made by placing a notice in the Montgomery County Register. This notice should include the donation made, the source of the donation, the name of the department receiving, the donation and the purpose for which the donation will be used. The Office of the County Executive is to be notified of all gifts received. Effective Date: 7/11/07.

MCEO NO. 190-07: DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS - Designation of Nonprofit Organizations Eligible to Directly Purchase or Rent MPDU's. The County Executive periodically designates housing development agencies and nonprofit corporations which may directly purchase or lease Moderately Priced Dwelling Units (MDPU's) from the builder under Section 25-A 8(b) of the Montgomery County Code, 2004. It has been determined that Landon School has demonstrated its ability to operate and maintain affordable housing and is eligible for participation in the MPDU program for the rental or purchase of MPDU's. Effective Date: 6/04/07.
MCEO NO. 191-07: DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS - Community Development Advisory Committee - Revision. The Montgomery County Government participates with the U.S. Department of Housing and Urban Development (HUD) in the Community Development Block Grant (CDBG), the Emergency Shelter Grant (ESG) and the HOME Investment Partnership Programs. The Montgomery County Department of Housing and Community Affairs (DHCA) is responsible for administering the federal CDBG, ESG and HOME programs, as well as other State and County funded activities. The DHCA wishes to continue to involve residents through the Community Development Advisory Committee (CDAC) in the review of the funding requests from not-for-profit agencies. The purpose of this Executive Order is to amend the existing Executive Order MCEO 176-95, dated September 26, 1995, in order to allow an increase in the membership from fifteen up to twenty. Executive Order MCEO 176-95 is amended as follows: A Community Development Advisory Committee (CDAC) is established, and its members shall be appointed by the County Executive to serve on this Committee. The CDAC shall have an appropriate number of members as determined by the Director of DHCA, with generally no fewer than fifteen nor more than twenty members serving during any given year. It is intended that membership on the Committee shall be broadly representative of the County as a whole. An advertisement for members will be made in local newspapers and through existing Commissions and Boards in the County as well as through direct outreach to persons with special needs, including lower income persons and those who were formerly homeless. Those persons who currently serve on a Board, Committee or Commission established by the County Council or County Executive, or who are employees of the Montgomery County Government, the Housing Opportunities Commission, or Maryland National Capital Park & Planning Commission, or any local government, or elected officials of any federal, state, or local government are not eligible to apply for membership on the CDAC. Criteria for appointment are familiarity with problems of low income neighborhoods within the County, familiarity with problems of a recognized special needs population or special expertise in the construction, acquisition or siting of affordable housing and especially in the provision of related supportive services. The CDAC has the following duties and responsibilities: (a) Hold an annual fall Community Development Needs Public Hearing conducted by the CDAC to review Community Development needs and hold other public hearings from time to time as deemed necessary by DHCA. (b) Assist the Department of Housing and Community Affairs in reviewing community and agency requests for federal, state and county funding. (c) Review the County's proposed Consolidated Plan and make recommendations on the plan, strategy and performance plans to the Director of DHGA. Members are appointed by the County Executive to serve three year terms. Members may be reappointed by the County Executive no more than once. (a) The chairperson shall be designated annually by the County Executive and may serve no more than two years. (b) Members who fail to attend 3 or more scheduled meetings during any 12 month period shall be considered as having resigned. (c) Current members may be appointed to additional full or partial terms beyond their original appointment as long as the total number of years served on the committee is not more than six years. A public hearing was held at 2:00 PM on Thursday, June 21, 2007, in the Lobby Level Auditorium of the Executive Office Building, 101 Monroe St., Rockville, Maryland, to consider public opinion on proposed Executive Regulation 19-07, Buildings - Energy Efficiency and Environmental Design. MCEO NO. 250-07: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Enforcement of Parking Regulations in the WMATA Grosvenor-Strathmore Garage by County Parking Enforcement Officers. The Strathmore Hall Foundation has requested that me County enforce short term parking limits at the Grosvenor-Strathmore garage so that these spaces are available, as intended, for patrons of the Education Center at the Music Center at Strathmore. Currently many of these short term spaces are being used as long term spaces in violation of the posted time limits. The garage is operated by the Washington Metropolitan Transportation Authority (WMATA). WMATA currently does not have the resources to enforce the posted time limits. The County is able to enforce these limits. A traffic order is necessary to provide the County's ' Department of Public Works and Transportation with sufficient authority to enforce parking regulations in the subject garage. Therefore, the Department of Public Works and Transportation and their parking enforcement contractors are hereby directed to enforce the limitations of short term meter parking in the Washington Metropolitan Transportation Authority's Grosvenor- Strathmore Garage located on Rockville Pike between Montrose Ave. & Tuckerman Lane.
