MCEO NO. 306-07: DEPARTMENT OF LIQUOR CONTROL - Amendment to FY08 Appropriation and Transfer. State law provides for the Director of Finance and the Director of the Department of Liquor Control, with the approval of the County Executive, to determine the amount of working capital required by the Department, and to retain from the Department's net profits the funds necessary to service DLC related debt and provide adequate working capital for the operation of the DLC. Because of this State law, both the County Attorney and the Attorney General have advised that the determination of the amount of funds required for these purposes is within the exclusive province of the County Executive, and is not subject to the County budget process. This request is for an appropriation guideline increase in FY08. Therefore, the total working capital is now $39,628,620. Effective Date: 10/11/07

The option contract between the Willows of Potomac Community Association and Montgomery County, Maryland, for the granting of an easement for the above- referenced project is accepted. The County Attorney is hereby directed to take all necessary steps to acquire the land and easement. Effective Date: 10/29/07.

MCEO NO. 319-07: DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION - Issuance of Parking Violation Notices in the Town of Somerset. On August 9, 2007, the Town of Somerset Council adopted with minor modifications, Chapter 31, "Motor Vehicles and Traffic," of the Montgomery County Code (2004), as amended, and the Council Resolution adopted under that Chapter. The town may designate certain persons as Parking Control Officers for the purpose of enforcing the applicable laws arid ordinances of the Town through the issuance of Montgomery County Parking Violation Notices issued by the Town-of-Somerset. Now, Montgomery County through the Montgomery County Department of Public Works and Transportation shall adopt the necessary procedures to process and collect the fines arid penalties of those revenues collected after deducting twenty-five percent (25%) to defray the expense of such processing and collection. The Department of Public Works and Transportation shall issue all necessary forms to the Town to enable proper enforcement and shall apply the same methods and procedures to the collection and processing of Town issued Parking Violation Notices as those issued by various County Agencies. Such procedures shall include any extraordinary collection activities deemed appropriate such as flagging Maryland Motor Vehicle Registration applications. Such activity shall begin on or about the effective date of this order, and continue until the County or the Town wishes to terminate the service provided that sixty days written notice is given in advance by either party.
