MCEO NO. 131-09: DEPARTMENT OF GENERAL SERVICES - Acquisition of the Site known as the Centerpark Property (also known as the Webb Tract) located on Snouffer School Road, Gaithersburg Maryland. In order to implement the Smart Growth Initiative, the County has identified the majority of the Centerpark Property (Lots 10,14 and 15 excluded) consisting of approximately 127.38 acres (the 'Site") as a suitable industrially zoned tract of land on which to relocate a number of County facilities, including, but not limited to, the Public Safety Training Academy, the Montgomery County Public School's Food Distribution Warehouse and Facilities Maintenance Facility and Maryland National Capital Park and Planning Commission's Maintenance Facility; and the Revenue Authority of Montgomery County has entered into separate negotiations to acquire Lots 14 and 15 of the Centerpark Property, for the purpose of extending the Runway Protection Zone for the adjacent Montgomery County Airpark, thus assuring a compatible governmental co-location on the site; and Montgomery County has completed negotiations to acquire the Site at a purchase price of $46,571,400. Further, Montgomery County has the option to purchase the Site in two separate phases. The County Executive directs the Department of General Services and the County Attorney to take all steps necessary to acquire part of the land identified in approved preliminary plan #1-04018, for North Airpark Business Park, excluding Lot 10, 14 and 15 at a purchase price of $46,571,400 for the purpose of relocating County facilities. The County Executive has determined that acquisition of the below-described property as parkland is necessary, in the public interest; and such determination was made after a public hearing held of February 5, 2009, and was approved for acquisition in the FY 09 Capital Budget. The County Attorney is hereby directed to acquire by purchase or condemnation, the following described property: Trustees of the Clarksburg United Methodist Church, Clarksburg Triangle Park, Parcel ID #02-1-17807, 0.92833+ acres, $385,000.00. Effective Date: 6/02/09

The County Executive has determined that acquisition of the below-described property as parkland is necessary, in the public interest; and such determination was made after a public hearing held on May 28, 2009, and was approved for acquisition in the FY 09 Capital Budget. The County Attorney is directed to acquire by purchase or condemnation, the following described property: Estate of Marian G. Rozier Josiah Henson Historic Site Parcel ID #04-9-85082, 23,292+ square feet, $720,000; of which $36,000 will be tendered to owner upon execution of the purchase contract. Effective Date: 6/16/09
MCEO NO. 134-09: DEPARTMENT OF TRANSPORTATION - Clarksburg Road Bridge (CIP #500900). Replace the existing deteriorating Clarksburg Road Bridge No. M-009B over Bennett Creek and re-construct approximately 450 feet of approach roadways to tie the new structure into the existing roadway on both sides. A Public Hearing was held on the project at 3:00 p.m. on October 10, 2008, the Hearing Examiner recommended approval of the project. Unless otherwise approved by the County, expenditures authorized by this Order plus expenditures accrued to date for this project shall not exceed $1,540,000.00 and shall be made payable from funds appropriated for CIP Project No. 500900. MCEO NO. 142-09: DEPARTMENT OF TRANSPORTATION - Dale Drive Sidewalk from Mansfield Road to Hartford Avenue (CIP No. 500904). The County Executive finds that public interest requires the construction of a sidewalk from Mansfield Road to Harford Avenue located in Silver Spring, Maryland, lying within the Thirteenth Election District as follows: Construction of 1,900 feet of five feet wide concrete sidewalk and five and a half feet wide concrete sidewalk adjacent to retaining walls on north side of Dale Drive from Mansfield Road to Hartford Avenue; Construction of two retaining walls within 125 feet and 190 feet in length and reconstruction of stairways on north side of Dale Drive; reconstruct the pavement of Dale Drive from Mansfield Road to Galveston Road due to relocation work on the gas, water and sewer mains in the road; replacement of the existing storm drain structures with new storm drain structures that can accommodate additional runoff from the proposed sidewalk. A Public Hearing was held on the project at 3:00 p.m. on April 14, 2009, the Hearing Examiner recommended approval of the project. Total estimated cost of the project, including engineering, land acquisition, site improvements and construction is $4,900,000.00. Unless otherwise approved by the County, expenditures authorized by this Order plus expenditures accrued to date for this project shall not exceed $4,900,000 and shall be made payable from funds appropriated for CIP Project No. 500904.
