MCER NO.1-05AM: ADOPTED FIRE AND RESCUE SERVICE REGULATION - Medical Standards for Operational Members and Candidates of the Montgomery County Fire and Rescue Service SUMMARY: This regulation requires that all incumbent Montgomery County firefighters/rescuers, career as well as volunteer, and candidates applying for those positions, must successfully complete a medical evaluation that complies with the provisions of National Fire Protection Association (NFPA) 1582, Standard on Comprehensive Occupational Medical Program for Fire Departments, 2003 Edition, with the exception of Chapter 8 and Annex C. This same medical evaluation will be used as a guideline only, when applied to all incumbent volunteer emergency medical service providers, and all candidates for those positions. The regulation also includes a new Section 6, Appeals. The adopted regulation supersedes Executive Regulation 29-89AM. ACTION: Executive Regulation 1-05AM, was approved by the County Council according to the Method 2 process, effective June 21, 2005. MCER NO. 2-05: ADOPTED DEPARTMENT OF ENVIRONMENTAL PROTECTION REGULATION - Water and Sewer Plan Review Fees SUMMARY: This regulation establishes a fee schedule for services and administrative activities related to processing requests for service area category changes that involve amending the County's Ten-Year Comprehensive Water Supply and Sewerage Systems Plan. ACTION: Executive Regulation 2-05, Water and Sewer Plan Review Fee, was approved by the County Council according to the Method 2 process, effective May 19, 2005. MCER NO. 5-05: ADOPTED DEPARTMENT OF FINANCE REGULATION - Certification of Payment of Taxes SUMMARY: This regulation changes the current $3/item fee charged to certify the payment or nonpayment of taxes to $10/item, in order to more fully recover the costs of the certification as allowed under Section 52-8 of the Montgomery County Code. The adopted regulation supersedes 53-92. ACTION: Executive Regulation 5-05, Certification of Payment of Taxes, was promulgated according to the Method 3 process and became effective June 22, 2005. MCER NO. 7-05: ADOPTED DEPARTMENT OF PUBLIC WORKS AND TRANSPORTATION REGULATION - System Benefit Charges - Residential Waste Estimates SUMMARY: This regulation establishes the calculated amount of solid waste generated per dwelling unit for single-family and multi-family dwellings. To calculate the residential systems benefit charge, each single-family dwelling unit and multi-family dwelling in a building consisting of six or fewer dwelling units in the County is estimated to produce 2.2842 tons per year of solid waste. Each dwelling unit in a building with seven or more dwelling units is estimated to produce 1.1116 tons per year of solid waste. The adopted regulation supersedes 7-04. ACTION: Executive Regulation 7-05, System Benefit Charges - Residential Waste Estimates, was approved by the County Council according to the Method 2 process, effective May 19, 2005. MCER NO. 10-05: ADOPTED DEPARTMENT OF PERMITTING SERVICES REGULATION - Permit Fees and Requirements Related to Construction Debris Reclamation Facility SUMMARY: This regulation, in general, increases by 6.4% permit and license fees that cover the administration, plan-review and enforcement programs of the Department of Permitting Services. The current policy of increasing fees for inflation only is not sufficient to cover department cost increases. A change in revenue policy, which would link fee increases more closely to labor cost increases, is proposed to address the department's funding needs. Section 6, Indexing of Fees to Labor Cost Increases, has also been added. The adopted regulation supersedes 38-01. ACTION: Executive Regulation 10-05, Permit Fees and Requirements Related to Construction Debris Reclamation Facility, was approved by the County Council according to the Method 2 process, effective June 14, 2005. AUTHORIZATION AND PROCEDURAL METHOD: Montgomery County Code, 1994, Section 59-C-9.84. Method 2. MCER NO. 11-05: ADOPTED DEPARTMENT OF PERMITTING SERVICES REGULATION - Schedule of Fees for Permits, Licenses and Inspections SUMMARY: This regulation increases by 6.4% permit and license fees that cover the administration, plan-review and enforcement programs of the Department of Permitting Services. It also corrects and updates the use and revision of Executive Regulation 15-03AM. New fees added to the Executive Regulation are: Electrical fee for existing multi-family buildings; Homeowner's Electrical Examination Fee; Homeowner's Electrical Re-Examination Fee; Electrician Good Standing Letter Fee. Section VII has been revised to reflect a change in the indexing of fees. Revisions to clarify existing fee descriptions have been made throughout the executive regulation. The adopted regulation supersedes 15-03AM. ACTION: Executive Regulation 11-05, Schedule of Fees for Permits, Licenses and Inspections, was approved by the County Council according to the Method 2 process, effective June 14, 2005.
