MCER NO. 3-09AM:  ADOPTED DEPARTMENT OF ECONOMIC DEVELOPMENT                                      Agricultural Land Preservation Easement Purchases

SUMMARY:  This Executive Regulation regulates the County's supplemental payment for Maryland Agricultural Land Preservation Foundation's purchase of agricultural land preservation easements and regulate the method of purchasing agricultural easements by the County, including the method for determining easement value, the method for ranking offers to sell easements to the County, and the terms of payment for easements purchased by the County.  The adopted regulation supersedes Executive Regulation 66-91.

ACTION:  Executive Regulation 3-09AM was approved by the County Council according to the Method 1 review process, effective August 26, 2010.

MCER NO. 27-09AM:  ADOPTED OFFICE OF HUMAN RESOURCES REGULATION

General Applicability of Personnel Regulations to Employees of Local 

                                 Fire and Rescue Departments  

SUMMARY:  This regulation amends Section 2-2(m) of the Montgomery County Personnel Regulations to clarify, in accordance with a recent decision by the Merit System Protection Board, that the Personnel Regulations are generally applicable to employees of Local Fire and Rescue Departments (LFRDs).  At the Board's request, the regulation also modifies Section 35-8 of the Personnel Regulations to indicate who must provide a response to an appeal filed by a LFRD employee with the Board.  The regulation also clarifies who must respond to an appeal filed by a volunteer firefighter or rescuer with the Board.  The adopted regulation supersedes Executive Regulations
12-00AMII, in part, and 14-09, in part.

ACTION:  Executive Regulation 27-09AM was approved by the County Council according to the Method 1 review process, effective July 27, 2010.

MCER NO. 2-10AMII:  ADOPTED DEPARTMENT OF ENVIRONMENTAL PROTECTION/DEPARTMENT

Montgomery County Home Energy Loan Program

SUMMARY:  This regulation establishes the administrative procedures for implementing the Montgomery County Home Energy Loan Program.

ACTION:  Executive Regulation 2-10AMII was approved by the County Council according to the Method 2 review process, effective July 27, 2010.

MCER NO. 3-10:  ADOPTED OFFICE OF HUMAN RESOURCES REGULATION                           

Hiring Preference for Persons with Disabilities

SUMMARY:  This regulation implements Bill No. 46-09 enacted by the Council on February 2, 2010.  The regulation amends Section 6 of the 2001 Montgomery County Personnel Regulations to establish and maintain a hiring preference for disabled veterans and persons with disabilities who apply for initial appointment to County merit positions in a normal competitive process and are among the highest rating category.  The adopted regulation supersedes Executive Regulation 12-00AMII, in part.

ACTION:  Executive Regulation 3-10 was approved by the County Council according to the Method 1 review process, effective July 20, 2010.
