MCER NO. 7-16:  ADOPTED DEPARTMENT OF PERMITTING SERVICES REGULATION
Fire Safety Code – Fire Protection Systems
SUMMARY:  This regulation amends Executive Regulation 19-13 and adopts and modifies certain standards published by the National Fire Protection Association (NFPA) involved with the installation, testing and maintenance of certain fire protection systems as required by the Montgomery County Building Code, the Montgomery County Fire Safety Code, and the Maryland State Fire Prevention Code.  These codes and the associated codes and standards incorporated by reference are adopted to set the minimum requirements to establish a reasonable level of safety from the hazards created by fire explosion, and dangerous conditions.  New buildings, new systems, or new conditions are subject to this regulation.  Existing buildings, existing systems, or existing conditions which are altered are subject to this regulation to the extent required by the Maryland Building Rehabilitation Code, the Montgomery County Fire Safety Code, and the Maryland State Fire Prevention Code.  Unaltered existing buildings, existing systems, or existing conditions are subject to this regulation only when an inimical or distinct hazard exists.
ACTION: Executive Regulation 7-16 was approved by the County Council according to the Method 2 review process, effective August 1, 2016.

MCER NO. 8-16:  ADOPTED DEPARTMENT OF PERMITTING SERVICES REGULATION
                        Fire Safety Code – Building Construction
SUMMARY:  This regulation amends Executive Regulation 20-13 and adopts and modifies the applicable editions of various National Fire Protection Association (NFPA) standards – most notably NFPA 1, Fire Code and NFPA 101, Life Safety Code – as adopted by the Maryland State Fire Prevention Code.  These codes and the associated codes and standards incorporated by reference are adopted to set the minimum requirements to establish a reasonable level of safety from the hazards created by fire, explosion, and dangerous conditions.  New buildings, new systems, or new conditions are subject to this regulation to the extent required by the Maryland Building Rehabilitation Code, the Montgomery County Fire Safety Code, and the Maryland State Fire Prevention Code.  Unaltered existing buildings, existing systems, or existing conditions are subject to this regulation only when an inimical or distinct hazard exists.  This regulation also incorporates the provisions of Executive Regulation 29-08AM, which established the requirements for effective fire department apparatus and water supply in urban, suburban and rural settings in Montgomery County.
ACTION:  Executive Regulation 8-16 was approved by the County Council according to the Method 2 review process, effective August 1, 2016.

MCER NO. 20-16:  ADOPTED DEPARTMENT OF POLICE AND OFFICE OF CONSUMER PROTECTION REGULATION
                         Secondhand Personal Property
SUMMARY: Changes were made to Chapter 44A, Secondhand Personal Property, by 2009 Laws of Montgomery County, ch.6 (Bill 33-08).  Consequently, amendments need to be made to Executive Regulation 50-89 as a result of the changes made in the underlying law.  Licenses are issued by the Office of Consumer Protection.  Certain technical amendments are also needed to make the Executive Regulation internally consistent after the passage of Executive Regulation 4-08.  In addition, amend the definition and allow for payment by in-store credit in addition to by check.
ACTION:  Executive Regulation 20-16 was promulgated according to the Method 3 process and became effective September 27, 2016.
