Based on evolving departmental and programmatic needs, this Program Manager II position has been updated, such that it will be supervising three (3) positions in the DHHS, OESS Connector Entity Program. Having reviewed and assessed the recently-updated Position Description for Position No. 017351, and in accordance with sections 33-102(4)(O) and (10)(A) – (C), 2-25D, and 2-64I ( See Editor’s Note) of the Code, the Chief Labor Relation Officer has determined that this Program Manager II, Grade 25 position is a ‘supervisory position’ within the meaning of Section 33-102(10)(A) – (C) and is, therefore, appropriately and necessarily excluded from the bargaining unit.
Any individual or agent of the certified bargaining representative may file an objection to this determination with the Labor Relations Administrator, with notice to the Chief Labor Relations Officer, within 10 days of the publication of this notice:

Office Services Coordinator (OSC)

In accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relation Officer has determined that the DHHS, Director’s Office Division, OSC, Grade 16 position, No. 019733 is appropriately and necessarily excluded from the bargaining unit, pursuant to Code Section 33-102(4)(E) (“an employee who provides direct staff or administrative support to the head of a principal department, office, or agency, or to a deputy or assistant within the immediate office of a head of a principal department, office, or agency.”). Due to the immediate administrative needs of the DHHS Director’s Office, the Position Description for Position No. 019733 (which, as of this writing, is vacant) was modified such that this OSC, Grade 16 position will now provide administrative support for and report directly to the DHHS Director.

Loss Prevention Field Officers

Having reviewed and assessed the duties attendant to the Loss Prevention Field Officer, Program Specialist II, Grade 21 occupational class, and in accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relation Officer has determined that these positions are appropriately included in the bargaining unit pursuant to Code Section 33-102(4) and, consistent therewith, do not fall under any of the exceptions set forth in Section 33-102(4)(A) – (Q) that would compel exclusion from the unit.

Having reviewed and assessed the duties attendant to the Administrative Specialist III, CEC Translation Unit, Grade 23 position, and in accordance with sections 33-105(b), 2-25D, and 2-64I (See Editor’s Note) of the Code, the Chief Labor Relation Officer has determined that this position (which, upon information, was created in the final quarter of 2024) is appropriately included in the bargaining unit pursuant to Code Section 33-102(4) and, consistent therewith, does not fall under any of the exceptions set forth in Section 33-102(4)(A) – (Q) that would compel exclusion from the unit.
