Montgomery County Safe Routes to School “Don’t Be Distracted” Creative Contest Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE OR WIN THE MONTGOMERY COUNTY SAFE ROUTES TO SCHOOL CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

MINORS MUST ASK THEIR PARENT OR LEGAL GUARDIAN FOR PERMISSION TO PARTICIPATE. IF A PARTICIPANT IS AN ELIGIBLE MINOR, HIS OR HER PARENT OR LEGAL GUARDIAN AGREES TO THESE OFFICIAL RULES ALONG WITH AND ON BEHALF OF HIS OR HER MINOR CHILD.

By entering, Entrant grants Sponsor an irrevocable, perpetual, royalty-free, freely transferable license to use the essay, artwork, or video for all purposes, in any and all media, whether now known or hereafter devised. By entering this Contest, you agree to acknowledge that this Contest is in no way sponsored, endorsed, or administered by or associated with YouTube and you agree to hold Sponsor, YouTube, and each of their parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of same harmless against any and all claims or liability arising directly or indirectly from use or misuse of a prize or participation in the Contest.

  1. Eligibility: The Montgomery County Safe Routes to School “Don’t be Distracted” Contest (the “Contest”) is open only to legal residents of Maryland, who are currently enrolled as a student of a Montgomery County Public School. Employees of Montgomery County Public Schools, Montgomery County Government, Sharp & Company and subsidiaries, affiliates and members of the immediate families (parent, child, or sibling) or households of any such employees, are not eligible to enter.
  2. Sponsor: The sponsor of this Contest is Montgomery County Department of Transportation, MD, located at 100 Edison Park Drive, 4 th Floor, Gaithersburg, MD 20878.
  3. Contest Period: The Contest period begins on December 17th, 2018 at 12:00:00 a.m. Eastern Standard Time (“EST”) and ends on March 8th, 2019 at 11:59:00 p.m. EST (the “Contest Period”).
  4. How to Enter: During the Contest Period, you may enter the Contest by submitting a 30-60 second public service announcement (PSA) Video Submission to help prevent distracted walking and driving. Entrants may also submit an artwork image about distracted walking and driving. All Entrants must go to http://www.montgomerycountymd.gov/DOT-PedSafety/SRTS/creativecontest.html and complete the Contest entry form in its entirety and submit their YouTube video file link or artwork image. When this form is submitted the Entrant will receive one (1) entry into the Contest.  Only complete and valid entries, as determined by the Sponsor and/or its Judges, will be eligible for the Contest drawing. There is a limit of one (1) entry per person.
  5. Email Entry: If Entrant wishes not to submit an entry via the Safe Routes to School website they may submit one (1) entry via email to Stephanie.Webber@montgomerycountymd.gov with the subject line “Safe Routes to School “Don’t Be Distracted Contest”. The email should contain the participant’s full name, school name, grade, email address, phone number, and artwork image or YouTube video file link.


    Video Submission Requirements:
By submitting a Video Submission, each Entrant expressly accepts and, to be eligible for the Prize, must comply with, the Entry Guidelines and Requirements, which are set forth below. Entrants must read these Official Rules carefully and accept them prior to submitting the URL. Please read them prior to creating a Video Submission in the Contest. In the event that a Video Submission does not comply with any of the terms of these Official Rules (including the YouTube Terms of Service and Community Guidelines), as determined by Sponsor in its sole discretion, such Video Submission will be void. Video Submissions that appear to duplicate any other submitted entries may be voided in Sponsor's sole discretion and only the first entry submitted (based on time/date) will be included in the Contest.


    Entry Guidelines and Requirements:

    • Must include an original video;
    • Must be uploaded to YouTube and submitted for consideration through the designated web page or emailed to Stephanie.Webber@montgomerycountymd.gov (no other form of submission will be accepted);
    • Must be at least 30 seconds but no more than one (1) minute(s) in length;
    • Must be in English;
    • Must not contain material that violates or infringes another's rights, including, but not limited to, privacy, publicity or intellectual property rights, including copyright infringement, or legal or moral rights of any third party, living or deceased;
    • Must not contain any music other than Entrant's original works (including composition, arrangement and lyrics);
    • Must have approval from any persons appearing in the Video Submission and the Entrant must be able to provide express written consent of every such person appearing in the Video Submission to Sponsor if requested;
    • Must not disparage Sponsor or any other person or party affiliated with the YouTube Video Contest and administration of this YouTube Video Contest;
    • Must not include any personally identifiable information, such as an Entrant's full name, address or telephone number;
    • Must be the sole, exclusive and original work of the Entrant and must not contain images or artwork, music, quotes, parodies or other materials not created by Entrant;
    • Must not contain any logos, brand names or trademarks, other than those of Sponsor;
    • Must not contain, facilitate, reference, or use material that is fraudulent, inappropriate, indecent, lewd, pornographic, obscene, hateful, tortious, defamatory, slanderous or libelous;
    • Must not contain, facilitate, reference or use material that contains prohibited content which shall include, but is not limited to, content that promotes, suggests, or encourages: i. gambling, including without limitation, any content related to online casinos, sports books, bingo or poker; ii. the use of firearms/weapons/ammunition, any illegal drugs, prostitution, pornography, nudity, profanity or other adult content, violence, or the use of alcohol or tobacco products; iii. the taking up of arms against any person, government or entity (or otherwise challenges or seek to overthrow any government);
    • Must not contain any viruses, spyware, malware, or other malicious components that are designed to harm the functionality of a computer in any way;
    • Must not contain, facilitate, reference, or use material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, ethnicity, religion, nationality, disability, sexual orientation, political orientation, citizenship, ancestry, marital status, or age; and
    • Must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the Entry is created.

  6. Selection of Winners:

    
Judging Criteria: Entries will be judged on the following criteria:

    1. Impact, originality and creativity (50 points)
    2. Does the video or artwork clearly and accurately address the topic of preventing distracted driving and walking (50 points)

    All winners are subject to verification. On or about March 29, 2019 (4) winners will be selected from among all eligible entries received. Odds of winning will depend upon the number of eligible entries received.

  7. Winner Verification and Notification: The potential winners will be notified by email, as determined solely by Sponsor, on or around March 29, 2019 on how to claim their prize. If a potential winner cannot be reached within seventy-two (72) hours of the initial notification attempt, he or she may be disqualified and the prize awarded to an alternate winner If a potential winner fails to respond to any notification attempt within the time period specified by Sponsor, or if any attempted notification or prize delivery is returned as undeliverable, the potential winner will be disqualified and forfeit his/her prize. Potential winners (and any minor winner’s parent or legal guardian on behalf of himself or herself and on behalf of the minor) may be required to complete, sign and return Affidavit of Eligibility/Liability Release/Model Release forms, and other applicable documents, which may require a social security number, before claiming his/her prize, as determined by Sponsor in its sole discretion. If a potential winner is a minor in his/her state of residence, the prize will be awarded to the minor’s parent or legal guardian and the parent or legal guardian will be required to complete, sign and return the Affidavit of Eligibility/Liability/Model Release forms. If a potential winner fails to complete and return any required affidavit and/or release within the period of time specified by Sponsor, the potential winner may be disqualified and forfeit his/her prize. All decisions of Sponsor shall be binding and final. By participating in the contest, entrants consent to the use of the entrant’s name, photograph, likeness, biography, voice and/or video for promotional purposes, including, but not limited to, online and on-air announcements, signage, posters, television, magazine articles, websites, social media sites (including, but not limited to Facebook and Twitter), and any other publication(s) at Sponsors’ sole discretion, worldwide and without limitation, and without additional compensation or consideration, except where prohibited by law. In the event of a conflict between the entry instructions and these contest rules, these contest rules shall control.

  8. Prizes:

    Grand Prize: $500 for college tuition, school supplies, or books (awarded as a $500 Visa Gift Card).

    (1st – 5th grade prize) - $100 Chipotle or Chick-Fil-A gift card.


    (6th – 8th grade prize) - $100 Chipotle or Chick-Fil-A gift card.


    (9th – 12th grade prize) - $100 Chipotle or Chick-Fil-A gift card.

    Total ARV of all prizes is $1,000.00. No substitution, cash redemption, or transfer of right to receive any prize will be allowed.

  9. General Rules: Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and/or to cancel, modify or suspend this Contest should entrant fraud or misconduct or other causes beyond the control of the Sponsor corrupt the administration, integrity, security or proper operation of the Contest. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest, or in the announcement of the prize. Each entrant releases and agrees to hold Sponsor harmless from and against any and all claims and liability arising from or in connection with participation in this Contest, use of the entrant’s mobile phone as permitted hereunder and/or use or redemption of the prize. Entrants assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of the prize. All federal, state, and local laws and regulations apply. Sponsor is not responsible for lost, late, illegible, incomplete, damaged, corrupted, mutilated, misdirected, misdelivered, undelivered, blocked or delayed entries or other communications, or for technical or human errors, delays or failures of any kind in connection with the submission, transmission, processing, storage or selection of entries, including, without limitation, any malfunctions or failures of computer hardware, computer software, networks or telephone equipment, any data loss or corruption, or any technical problems or traffic congestion on the Internet or at any website or any combination thereof. Caution: Any attempt by a participant to deliberately damage any Web site or undermine the legitimate operation of the Contest is a violation of criminal and/or civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the law. Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of Montgomery County, Maryland All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Montgomery County, Maryland.
  10. Use of Entry Information: The Sponsor will not use submitted information for any purpose other than to contact the potential winners.
