Certified Site Plan Enforcement Compliant and Inspection Process
Montgomery County Planning Board and DPS crafted a Memorandum of Understanding that transferred to DPS compliance and enforcement of Certified Site Plans. DPS does this by conducting onsite inspections for compliance during development, reviewing site plans associated with building permits, and investigating complaints.
When a project receives official approval from the Maryland National Capital Park and Planning Commission (M-NCPPC), the amount and level of detail required for that project’s design is specified by M-NCPPC. This includes not only zoning requirements, but also requirements that will ultimately reflect the quality of that development. Certified Site Plans reflect the highest level of detail M-NCPPC can require for development within Montgomery County. These plans act as the overall controlling legal requirements for a project and all permit and construction activities must abide by them.
Inspectors are assigned to areas. The Inspection Area Map will give you the inspector’s name and phone number. You can also find your inspector and their contact information by using our Find My Inspector application.
Forest conservation inspections and enforcement are not part of the MOU. MNCPPC staff are responsible for forest conservation inspections and complaints.
You can register complaints through 311, online or registered mail.
Type your address into the zoning map and click “Dev.Info” on the blue bar. If a site plan is listed, you are subject to that plan and any amendments.
If a site plan property is found to be non-compliant, DPS inspectors may issue notices of non-compliance, corrective orders, citations, and stop work orders independently or in combination. Non-compliant properties also are flagged and issuance of additional permits, inspections and use and occupancy finals can be withheld.
